Synopsis As Introduced
Amends the Developmental Disability and Mental Disability Services Act. Provides for a Community Residential Choices Program to allow a person with a developmental disability to participate in a community-based residential program where he or she is grouped in a home with no more than 3 roommates, each of whom has a developmental disability, whose disabilities, service needs, ages, and gender are compatible. Commencing with the State fiscal year beginning July 1, 2007, requires the Department of Human Services to establish Community Residential Choices Program sites in geographic locations throughout the State. Provides that for the State fiscal year beginning July 1, 2007, the Department shall make non-crisis placement slots available to no fewer than 80 persons; for the State fiscal years beginning on July 1, 2008 and July 1, 2009, the Department shall establish non-crisis placement slots for an additional 80 persons each year. Provides that the Department shall reimburse each provider of a Community Residential Choices Program at a rate equal to 100% of the provider's cost of providing those services, including the cost of acquiring, renovating, or converting the home and the cost of transportation. Effective immediately.

Senate Committee Amendment No. 1
Replaces a reference to "roommates" with "housemates". Requires consideration of the interests of a person with a developmental disability in determining compatibility. Makes the program available to persons age 18 and older (instead of between 18 and 59). Replaces references to "placement slots" with "placements". In connection with reimbursement rates under the program, makes changes concerning modifying an existing home and transportation.

 Fiscal Note (Dept. of Human Services)
 Estimating an annual cost of $60,000 for each individual served, the annualized cost of serving 80 persons in FY 2008 would be $4,800,000. Adding another 80 persons in FY 2009 would bring the total cost to $9,600,000 for that year (for 160 total persons in service). Adding another 80 persons in FY 2010 would bring the total cost to $14,400,000 for 240 total persons in service.

Senate Floor Amendment No. 2
Provides that each participant in the Community Residential Choices Program shall have his or her own individual private (instead of own private) bedroom. Provides that the program shall be available to persons over the age of 18 (instead of age 18 and older). Provides for reimbursement of program providers at the customary rate for a community-based residential program for persons with developmental disabilities, including necessary and appropriate support services (instead of at a rate equal to 100% of the provider's cost of providing services, including transportation and including the cost of acquiring the home, renovating the home, or modifying an existing home). Deletes a provision concerning an annual adjustment of the reimbursement rate. Provides that a person diagnosed with an autism spectrum disorder may be assessed for eligibility for services under Home and Community-Based Services Waivers for persons with developmental disabilities, without regard to whether that person is also diagnosed with mental retardation, so long as the person otherwise meets applicable level-of-care criteria under those waivers; and provides that this provision does not create any new entitlement to a service, program, or benefit, but shall not affect any entitlement to a service, program, or benefit created by any other law.

House Committee Amendment No. 1
Deletes reference to:

Replaces everything after the enacting clause. Reinserts provisions substantially similar to those of the bill, amending the Developmental Disability and Mental Disability Services Act, but with changes that include the following: (1) changes the statement of the purpose of the community residential choices program; (2) provides that "developmental disability" may include (instead of includes) an autism spectrum disorder; (3) provides that commencing with the State fiscal year beginning on July 1, 2007, subject to appropriation, the Department of Human Services shall fund residential capacities in geographic locations in the State with the goal of placing no fewer than 80 individuals who meet the emergency or critical need criteria of the Department's developmental disabilities cross-disabilities database, and who also meet the Department's developmental disabilities priority population criteria for residential services and whose parents are over the age of 60, in community-based residential programs with chosen housemates, and provides that priority in the allocation of funds for this program shall be given to individuals who choose to reside with 3 or fewer individuals; (4) deletes provisions concerning placements for the State fiscal years beginning on July 1, 2008 and July 1, 2009; and (5) deletes provisions concerning reimbursement rates. Effective immediately.
