Synopsis As Introduced
Amends the Private Sewage Disposal Licensing Act and the Environmental Protection Act to prohibit the installation of surface discharging septic systems without a National Pollutant Discharge Elimination System (NPDES) permit issued by the Illinois Environmental Protection Agency. Requires the amendment of the private sewage disposal code to reflect this permit requirement. Provides that the Department of Public Health may not independently and without the participation of the Agency permit the installation by any person of a surface discharging septic system. Provides that the Advisory Commission on Private Sewage Disposal shall advise and aid the Director of Public Health in reviewing and suggesting methods of mitigating the negative impacts of existing surface discharging septic systems operating within the State. Effective June 30, 2008.

Deletes everything after the enacting clause. Reinserts the contents of the bill as introduced with the following changes. In the Private Sewage Disposal Licensing Act, replaces references to "surface discharging septic system" with "surface discharging private sewage disposal system" and defines the new term as a sewage disposal system that discharges to waters of the State. Removes the definition of "waters of the State" and provides that the term is as used in the Environmental Protection Act. Provides that beginning January 1, 2009 (instead of July 15, 2008), a surface discharging private sewage disposal system that enters the waters of the State shall not be installed by any person without the issuance of a coverage letter under a NPDES permit issued by the Illinois Environmental Protection Agency (instead of requiring a NPDES permit). Removes the provision that prohibits the Department of Public Health from, independently and without the participation of the Agency, permitting the installation of a surface discharging septic system. Restores current law in the Section concerning the Advisory Commission on Private Sewage Disposal. In the Environmental Protection Act, sets forth a General Assembly finding that compliance with the federal Clean Water Act (instead of NPDES) dictates that the Agency require NPDES permits for surface discharging private sewage disposal systems (instead of requires the Agency to take regulatory authority over and grant permits for the installation and current operation of the systems). Restores current law in the Section concerning prohibited actions. Effective June 30, 2008.
