Synopsis As Introduced Amends the Criminal Code of 1961 and the Unified Code of Corrections. Provides that a person convicted of a second or subsequent offense of domestic battery is ineligible for probation, periodic imprisonment, or conditional discharge and must serve a minimum term of imprisonment of one year. Provides that a person convicted of a second or subsequent offense of aggravated domestic battery is ineligible for probation, periodic imprisonment, or conditional discharge and must serve a minimum term of imprisonment of at least 3 years or a mandatory extended term of imprisonment of at least 7 years.
House Floor Amendment No. 1 Provides that a person convicted of a second or subsequent violation of aggravated domestic battery will (rather than must) be sentenced to a mandatory term of imprisonment of not less than 3 years and not more than 7 years or an extended term of imprisonment (rather than a mandatory extended term) of not less than 7 years and not more than 14 years.
