Synopsis As Introduced Amends the Criminal Code of 1961. Provides that a person who, in committing a domestic battery, strangles another individual commits aggravated domestic battery. Provides that a person commits aggravated battery when he or she, in committing a battery, strangles another individual. Defines "strangle". Effective immediately.
House Committee Amendment No. 1 Provides that aggravated battery by strangulation is a Class 1 felony if: (1) the person used or attempted use a dangerous instrument while committing the offense; or (2) the person caused great bodily harm or permanent disability or disfigurement to the other person while committing the offense; or (3) the person has been previously convicted of aggravated battery by strangulation under the laws of this State or similar laws of any other state.
