Synopsis As Introduced
Amends the Right to Privacy in the Workplace Act. Provides that until any Employment Eligibility Verification System, including the E-Verify program and the Basic Pilot program, as authorized by 8 U.S.C. 1324a, Notes, Pilot Programs for Employment Eligibility Confirmation (enacted by PL 104-208, div. C, title IV, subtitle A), is able to automatically verify the work-authorization status of 99% of employees: (1) employers are discouraged from participating in any Employment Eligibility Verification System, unless otherwise required by federal law; and (2) the State of Illinois shall not participate in any Employment Eligibility Verification System, unless otherwise required by federal law. Effective immediately.

Adds reference to:
820 ILCS 55/15from Ch. 48, par. 2865

Replaces everything after the enacting clause. Amends provisions of the Right to Privacy in the Workplace Act concerning restrictions on the use of Employment Eligibility Verification Systems to provide that employers are discouraged (rather than prohibited) from participating in any Employment Eligibility Verification System, unless otherwise required by federal law and the State of Illinois shall not participate in any Employment Eligibility Verification System unless otherwise required by federal law. Requires an employer enrolled in an Employment Eligibility Verification System to make an attestation with specified contents. Provides that an employee or applicant for employment may directly commence an action in the circuit court to enforce specified provisions without first filing a complaint with the Department of Labor and imposes penalties for violations. Effective immediately.

Senate Floor Amendment No. 2
Deletes language providing that an employee or applicant for employment may directly commence an action in the circuit court to enforce specified provisions without first filing a complaint with the Department of Labor. Changes the standard for certain violations concerning the use of Employment Eligibility Verification Systems by requiring that they be willful and knowing.
