Synopsis As Introduced
Amends the Criminal Code of 1961. Provides that if the trier of fact determines that the evidence was sufficient beyond a reasonable doubt to sustain the verdict of guilty for first degree murder but does not foreclose all doubt respecting the defendant's guilt, the trier of fact may not determine that death is the appropriate sentence and the court shall sentence the defendant to a term of natural life imprisonment.

House Committee Amendment No. 1
Deletes everything after the enacting clause. Amends the Criminal Code of 1961 relating to first degree murder. Provides that if a separate sentencing proceeding is conducted before a jury, the court shall instruct the jury that if the jury unanimously determines that the evidence leaves no doubt respecting the defendant's guilt, the jury shall determine that death may be the appropriate sentence, and the separate sentencing proceeding shall continue to a consideration of the factors in aggravation and mitigation. Provides that if a separate sentencing proceeding is conducted before the court alone, and if the court determines that the evidence leaves no doubt respecting the defendant's guilt, the court shall determine that death may be the appropriate sentence, and the separate sentencing proceeding shall continue to a consideration of the factors in aggravation and mitigation.
