Synopsis As Introduced
Amends the Illinois Public Labor Relations Act. Makes a technical change in a Section concerning the short title.

Replaces everything after the enacting clause. Amends the Illinois Public Labor Relations Act. Defines "public employee" to include home care and home health workers, such as personal care attendants, personal assistants, and maintenance home health workers, who provide services through the Home Services Program of the Department of Human Services, no matter whether those persons provide those services through a direct fee-for-service arrangement, a managed care organization or other intermediary, or otherwise (now, the only Home Service Program providers who are included in that definition are personal care attendants and personal assistants). Specifies that home care and home health workers are not public employees for any purposes not specifically provided for in Public Act 93-204 or in the amendatory Act. Defines "employer" to include the State with respect to home care and home health workers who provide services through the Home Services Program, no matter whether those persons provide those services through direct fee-for-service arrangements, a managed care organization or other intermediary, or otherwise (now, the only Home Service program providers for whom the State qualifies as an employer are personal care attendants and personal assistants). Limits collective bargaining, in the case of these employees, to terms and conditions of employment that are under the State's control. Makes corresponding changes in the Disabled Persons Rehabilitation Act. Effective immediately.

Senate Committee Amendment No. 1
Adds reference to:
5 ILCS 315/28 new

Replaces everything after the enacting clause. Reinserts the provisions of the engrossed bill, but provides that the changes made by the amendatory Act apply to home care and home health workers who function as personal care attendants, personal assistants, and individual maintenance home health workers and who work under the Home Services Program under Section 3 of the Disabled Persons Rehabilitation Act (rather than to home care and home health workers, including personal care attendants, personal assistants, and individual maintenance home health workers, who work under the Home Services Program). Provides that the changes made by the amendatory Act do not apply to workers or consumers in the Home Based Support Services Program in the Department of Human Services Division of Developmental Disabilities. Effective immediately.
