Synopsis As Introduced
Amends the Medical Practice Act of 1987. Makes changes concerning the prohibition against fee splitting. Provides that a failure to provide copies of medical records as required by law may be grounds for disciplinary action (rather than failure to transfer copies). Removes the phrase "provide medical direction" from provisions that make the inability or repeated failure to adequately collaborate with a licensed advanced practice nurse grounds for disciplinary action. Effective immediately.

Deletes everything after the enacting clause. Reinserts the bill as introduced with the following changes. In the fee splitting provisions of the Medical Practice Act of 1987, (i) allows 2 or more licensed health care workers to each receive adequate compensation for concurrently rendering services to a patient and to divide the fee for such service whether or not the worker is employed, (ii) makes changes in the provisions describing the entities that may pool, share, divide, or apportion the professional fees and other revenues, and (iii) makes technical changes. Adds the same provisions to the Optometric Practice Act of 1987. Effective immediately.

Senate Committee Amendment No. 1
Amends the Medical Practice Act of 1987. In provisions prohibiting fee splitting, removes language providing that the provisions do not prohibit the payment of rent or other remuneration paid by a licensee for the lease, rental, or use of space, staff, administrative services, or equipment and makes other changes. Amends the Illinois Optometric Practice Act of 1987. In provisions prohibiting fee splitting, provides that the provisions do not prohibit certain payments by a licensee for the lease, rental, or use of space, staff, administrative services, franchise agreements, marketing required by franchise agreements, or equipment. Makes other changes.
