Synopsis As Introduced
Amends the Juvenile Court Act of 1987. Provides that any minor under 18 years of age who has been declared dependent by a juvenile court can be deemed eligible by that court for long-term foster care due to abuse, neglect, or abandonment if that minor is otherwise eligible for special immigrant juvenile status under federal law. Effective immediately.

Adds reference to:
705 ILCS 405/2-4a new

Deletes all. Amends the Juvenile Court Act of 1987. Provides that a special immigrant minor who has been made a ward of the court and who meets certain eligibility criteria may be deemed eligible for long-term foster care due to abuse, neglect, or abandonment and remain in the jurisdiction of the juvenile court until his or her special immigrant juvenile status and adjustment of status applications are adjudicated. Effective immediately.

House Floor Amendment No. 2
Eliminates reference to "prior legal guardian" in the finding by the court that reunification is not a viable option. Provides in the definition of "special immigrant minor" that the determination that it would not be in the minor's best interest to return the minor to his or her previous country of last habitual residence or country of nationality must be made by the juvenile court.
