Synopsis As Introduced
Amends the Criminal Code of 1961. Makes a technical change in a Section concerning the definition of "conviction".

Deletes all. Amends the Code of Criminal Procedure of 1963. Provides that, in a domestic violence prosecution, a prior statement made by a person protected by the Illinois Domestic Violence Act of 1986, that is not specifically covered by any other hearsay exception but has equivalent circumstantial guarantees of trustworthiness, is not excluded by the hearsay rule if the declarant is identified as unavailable as a witness and the court determines that: (1) the statement is offered as evidence of a material fact; and (2) the statement is more probative on the point for which it is offered than any other evidence which the proponent can procure through reasonable efforts; and (3) the interests of justice will best be served by admission of the statement into evidence. Also, if and only if House Bill 2526 of the 93rd General Assembly becomes law, undoes the changes made by that bill to Section 115-10.2 of the Code of Criminal Procedure of 1963, relating to the unavailability of witnesses. Effective immediately.
