Synopsis As Introduced
Amends the Environmental Protection Act. Makes technical changes in a Section concerning the annual testing of well water.

House Committee Amendment No. 1
Deletes reference to:
415 ILCS 5/13.2
Adds reference to:
415 ILCS 5/42from Ch. 111 1/2, par. 1042

Deletes everything after the enacting clause. Amends the Environmental Protection Act. Provides that the injunction that the proper State's Attorney or the Attorney General may request, in order to restrain violations of this Act, any rule or regulation adopted under this Act, any permit or term or condition of a permit, or any Board order, may be prohibitory or mandatory. Provides that the injunction may also be requested in order to require such other actions as may be necessary to address violations of this Act, any rule or regulation adopted under this Act, any permit or term or condition of a permit, or any Board order. Effective immediately.

 State Debt Impact Note (Economic and Fiscal Commission)
 As amended by HA1, would not affect the level of state indebtedness.

 Fiscal Note (Environmental Protection Agency)
 As amended by HA1, no fiscal impact.

 Housing Affordability Impact Note (Housing Development Authority)
 This legislation, as amended by HA 1, will have no effect on the cost of constructing, purchasing, owning, or selling a single-family residence.

 Home Rule Note (Department of Commerce and Economic Opportunity)
 House Bill 5823 (HA #1) does not pre-empt home rule authority.

 State Mandates Fiscal Note (Department of Commerce and Economic Opportunity)
 House Bill 5823 (HA #1) does not create a State mandate under the State Mandates Act.

 Judicial Note (Admin Office of the Illinois Courts)
 As amended by HA1, may increase judicial workloads to a limited extent. However, would not increase the number of judges needed in the state.

 Pension Note (Economic and Fiscal Commission)
 House Bill 5823, as amended by House Amendment 1, would not impact any public pension fund or retirement system in Illinois.
