Synopsis As Introduced
Amends the Conveyances Act. Makes a technical change in a Section concerning livery of seizin.

Senate Floor Amendment No. 2
Adds reference to:
20 ILCS 2705/2705-555was 20 ILCS 2705/49.13

Deletes everything after the enacting clause. Amends the Department of Transportation Law of the Civil Administrative Code of Illinois. Provides that in counties with a population of not less than 500,000 (instead of "counties with a population of not less than 500,000 and not more than 800,000"), a lease by the Department of Transportation (now a lease by the Department of Transportation to any other department of State government, any authority, commission, or agency of the State, or a municipality, county, or township of the State) may be for a period of time no longer than 35 (instead of 25) years.

House Committee Amendment No. 1
Deletes everything. Amends the Department of Transportation Law of the Civil Administrative Code of Illinois. Provides that, in counties with a population of not less than 3,000,000, a lease initially entered into by the Department of Transportation within one year after the effective date of the amendatory Act, including in any land lease the corresponding vertical rights, subterranean and air rights, and sublease rights, may be for a period of time no longer than 35 years.

House Floor Amendment No. 2 (Tabled 5/31/2004)
Provides that, in counties with a population of not less than 3,000,000, a lease of land or property by the Department of Transportation initially entered into within one year after the effective date of the amendatory Act shall be at fair market value unless the land or property is to be used for a public purpose.

House Floor Amendment No. 3
Provides that, in counties with a population of not less than 3,000,000, a lease of land or property by the Department of Transportation initially entered into within one year after the effective date of the amendatory Act shall be at fair market value.

 Fiscal Note (Department of Transportation)
 This legislation allows the Department to lease certain properties in Cook County for a period of 35 years. The leases will be for fair market value, and lease revenues will be deposited into the Road Fund. The actual amount of Road Fund revenue generated by these leases will depend on the number of parcels leased and the fair market value of those leases.

 Fiscal Note (Department of Central Management Services)
 Senate Bill 2247, as amended by House Amendment 2, anticipates no significant impact.
