Deletes everything after the enacting clause. Amends the Firearm Owners Identification Card Act. Requires a person to have a currently valid Firearm Owner's Identification Card issued in his or her own name by the Department of State Police in order to acquire or possess a stun gun or taser. Exempts certain military, law enforcement, and other specified persons. Amends the Criminal Code of 1961. Provides that a person who acquires or possesses a stun gun or taser must obtain at least 4 hours of instruction in the use of a stun gun or taser approved by the Department of State Police. Provides that a person who commits a criminal offense while armed with a stun gun or taser shall be sentenced for an offense that is one class higher than the offense committed while unarmed or while armed with another weapon. Provides that if the offense committed while armed with a stun gun or taser is first degree murder or a Class X felony, then the defendant shall be sentenced to an extended term sentence for that offense.
Further amends the Criminal Code of 1961. Provides that it is unlawful to deliver a stun gun or taser without withholding delivery of the stun gun or taser for at least 24 hours after application for its purchase has been made. Provides exemptions.
House Floor Amendment No. 3 Provides that a person who commits a criminal offense while armed with a stun gun or taser shall be sentenced for an offense that is one class higher than the offense committed while unarmed instead of one class higher than the offense committed while unarmed or while armed with another weapon.
