New Act


Synopsis As Introduced
Creates the Continuity of Patient Care for Immunosuppressant Drugs Act. Provides that a health insurance policy or health care service plan contract that covers immunosuppressant drugs may not limit, reduce, or deny coverage of immunosuppressant drugs if prior to the limitation, reduction, or denial of coverage the insured was using the drug and was covered under the policy or contract and the drug was covered under the policy or contract. Provides that nothing in the Act shall prohibit an insurer from making changes in its benefit design that applies to all covered drugs or from increasing cost-sharing obligations due to a percentage coinsurance payment that necessarily increases with an increase in the underlying drug prices.

House Committee Amendment No. 1
Provides that the provisions concerning continuity of patient care shall not prohibit an insurer from using managed care pharmacy tools in cases where the insured's physician or healthcare provider gives written approval of the use of such management tools and the insurer gives written disclosure to the insured of the use of such management tools.

House Committee Amendment No. 2
Deletes everything after the enacting clause. Creates the Organ Transplant Quality Assurance Act. Provides that when a prescribing physician has indicated on a prescription "may not substitute", a health insurance policy or health care service plan that covers immunosuppressant drugs may not require or cause a pharmacist to interchange another immunosuppressive drug or formulation without certain notification and documented consent. Provides that in accordance with the Pharmacy Practice Act, the prescribing person may place a controlling mark beside "may not substitute" on the prescription form to direct the pharmacist. Provides that co-payments, deductibles, or other charges for any prescription for which another immunosuppressive drug or formulation is not interchanged shall remain the same for the enrollment period. Provides that the Act does not apply to medication orders issued for immunosuppressive drugs for any in-patient care in a licensed hospital. Makes other changes.

Senate Committee Amendment No. 2
Replaces everything after the enacting clause with the engrossed bill with the following changes. Provides that the Act may be cited as the Organ Transplant Medication Notification Act (instead of the Organ Transplant Quality Assurance Act). Provides that the Act shall apply solely to cases of immunosuppressive therapy when (i) an immunosuppressant drug has been prescribed to a patient to prevent the rejection of transplanted organs and tissues and (ii) a prescribing physician has indicated on a prescription "may not substitute". Provides that at least 60 days prior to making any formulary change that alters the terms of coverage for a patient receiving immunosuppressant drugs or discontinues coverage for a prescribed immunosuppressant drug that a patient is receiving, a policy or plan sponsor must, to the extent possible, notify the prescribing physician and the patient. Provides that as an alternative to providing written notice, a policy or plan sponsor may provide the notice electronically. Provides that at the time a patient requests a refill of the immunosuppressant drug, a policy or plan sponsor may provide the patient with the written notification along with a 60-day supply of the immunosuppressant drug. Makes other changes.
