Synopsis As Introduced
Amends the Illinois Vehicle Code. Provides that a graduated driver's license shall not be issued to an applicant under 18 years of age if the applicant has been charged with a violation of provisions of the Liquor Control Act of 1934 concerning alcohol and underage persons or a similar provision of a local ordinance for which a disposition has not been rendered at the time of the application. Provides that the Secretary of State shall cancel the license or permit of a minor under 18 years of age upon determination that, at the time of license issuance, the minor had been charged with a violation of provisions of the Liquor Control Act of 1934 concerning alcohol and underage persons or a similar provision of a local ordinance for which a disposition had not been rendered. Provides that the Secretary of State shall cancel the graduated driver's license of a license holder that is 18 years of age or older upon determination that, at the time of license issuance when the license holder was under 18 years of age and held an instruction permit, he or she had been issued a traffic citation or charged with a violation of provisions of the Liquor Control Act of 1934 concerning alcohol and underage persons or a similar provision of a local ordinance for which a disposition had not been rendered.

Replaces everything after the enacting clause. Amends the Illinois Vehicle Code. Provides that in order to qualify for certification to provide adult driver education, an applicant must authorize a background investigation including the use of his or her fingerprints to determine if the applicant has ever been convicted of a crime and if so the disposition of those convictions. Authorizes the Secretary of State to work with federal, State, and local government officials in performing this investigation. Provides that the applicant shall pay any other fingerprint-related fees. Provides that information received by the Secretary in the course of this investigation shall be provided to the applicant, and any criminal conviction information shall be confidential, except that this information may be used in an administrative hearing relating to the denial, cancellation, suspension, or revocation of certification. Provides that an employee of the Secretary of State that makes an unauthorized disclosure of this information is guilty of a Class A misdemeanor.
