Synopsis As Introduced
Amends the Sanitary District Act of 1917 and the Code of Civil Procedure. Provides that no prior approval of the Illinois Commerce Commission shall be required for the condemnation of sewage collection and treatment works owned by a public utility and located within the boundaries of the sanitary district if the district continues to operate the works as a sewage collection and treatment system. Effective immediately.

Deletes everything after the enacting clause. Reinserts the provisions of the introduced bill. Further amends the Sanitary District Act of 1917. In a Section that provides that a sanitary district may annex certain territory that is contiguous to it, strikes a provision stating that territory that is separated from the sanitary district by only a forest preserve district may be annexed to the sanitary district. Provides that any territory to be annexed to a sanitary district may be considered contiguous to the sanitary district notwithstanding that the territory is separated from the sanitary district by property that is owned by a forest preserve district, a public agency, or a not-for-profit corporation if the property does not require sanitary sewer service. Provides that the property owned by the forest preserve district, public agency, or not-for-profit corporation shall not be considered part of the sanitary district and shall not be subject to rights-of-way without the approval of the legal owner of the property. Effective immediately.

Deletes everything after the enacting clause. Amends the Municipal Code. Provides that whenever a sanitary district has acquired an easement granting the sanitary district the right to construct and operate a sanitary sewer system or part of a sanitary sewer system over property that connects the sanitary district to a municipality, the municipality and the sanitary district may enter into a contract for the use of the sanitary sewer system regardless of whether the sanitary district is adjacent to the municipality. Amends the Sanitary District Act of 1917. Provides that a sanitary district may exercise its powers of eminent domain with respect to a public utility only after approval by the Illinois Commerce Commission. Sets forth the procedures by which a sanitary district may petition the Commission for approval, including procedures for objections. Sets forth criteria by which the Commission shall approve the taking. Reinserts the provisions of the engrossed bill related to annexation of land by a sanitary district that is separated from the sanitary district by property owned by a forest preserve district or any public agency or not-for-profit corporation. Effective immediately.
