SYNOPSIS AS INTRODUCED:

New Act

Creates the Cannabis Delivery License Act. Provides that a Cannabis Delivery License shall authorize the license holder to deliver cannabis or cannabis-infused products purchased from a licensed dispensary directly to consumers within Illinois. Sets out application and operational requirements. Provides for penalties and enforcement. Requires the Department of Financial and Professional Regulation to adopt rules. Effective immediately.

A BILL FOR

AN ACT concerning cannabis.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Cannabis Delivery License Act.

Section 5. Purpose. The purpose of this Act is to regulate the delivery of cannabis to consumers in Illinois, ensure public safety, and promote equity by reducing barriers to entry for social equity applicants.

Section 10. Definitions. As used in this Act:

"Cannabis" has the meaning ascribed to it in the Cannabis Regulation and Tax Act.

"Delivery" means the transportation of cannabis or cannabis-infused products to a consumer from a licensed dispensary.

"Department" means the Illinois Department of Financial and Professional Regulation.

"Social Equity Applicant" has the meaning ascribed to it in the Cannabis Regulation and Tax Act.

Section 15. Cannabis Delivery License.

(a) A Cannabis Delivery License shall authorize the license holder to deliver cannabis or cannabis-infused products purchased from a licensed dispensary directly to consumers within Illinois.

(b) License holders must comply with all applicable State and local laws, including transportation and tracking requirements established by the Department.

(c) Delivery services may only be conducted on behalf of licensed dispensaries.

Section 20. Application requirements.

(a) Applicants for a Cannabis Delivery License must submit an application to the Department, including:

(1) proof of compliance with zoning requirements;

(2) a proposed delivery plan demonstrating compliance with State law;

(3) background check authorization for all principal officers; and

(4) payment of applicable fees, unless waived under subsection (c).

(b) Applications will be reviewed and approved based on criteria established by the Department.

(c) Fees for applications and license issuance shall be waived for social equity applicants who:

(1) meet the definition of a social equity applicant under the Cannabis Regulation and Tax Act; and

(2) do not currently hold any other cannabis license issued under Illinois law.

Section 25. Operational requirements.

(a) Delivery personnel must:

(1) be at least 21 years of age;

(2) possess a valid driver's license; and

(3) be employees of the licensed delivery service.

(b) All deliveries must:

(1) be conducted in vehicles equipped with GPS tracking;

(2) use secure, tamper-proof packaging; and

(3) be recorded in the State's cannabis tracking system.

(c) Deliveries may only occur during hours authorized by the Department.

Section 30. Penalties and enforcement.

(a) Violations of this Act or rules adopted under this Act may result in suspension or revocation of the Cannabis Delivery License.

(b) The Department may impose civil penalties for noncompliance, as established by rule.

Section 35. Rulemaking authority. The Department shall adopt rules as necessary to implement and enforce the provisions of this Act, including but not limited to:

(1) application and renewal procedures;

(2) delivery service standards; and

(3) recordkeeping and reporting requirements.

Section 99. Effective date. This Act takes effect upon becoming law.
