SYNOPSIS AS INTRODUCED:

30 ILCS 500/55-30 new

Amends the Illinois Procurement Code. Creates the State Procurement Diversity and Inclusion Task Force. Provides that the Task Force shall study the underrepresentation of minorities, women, and persons with disabilities, and members of the LGBTQ+ community, with regard to corporate diversity and State of Illinois procurement opportunities and awards. Sets forth the membership of the Task Force. Contains provisions concerning reports. Effective immediately.

A BILL FOR

AN ACT concerning business.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Procurement Code is amended by adding Section 55-30 as follows:

(30 ILCS 500/55-30 new)

Sec. 55-30. State Procurement Diversity and Inclusion Task Force.

(a) The State Procurement Diversity and Inclusion Task Force is hereby created.

(b) The Task Force shall study the underrepresentation of minorities, women, and persons with disabilities, and members of the LGBTQ+ community, with regard to corporate diversity and State of Illinois procurement opportunities and awards. The Task Force shall review the required business filings that require disclosure of a business entity's demographic makeup, the Business Enterprise Program, and the Illinois Procurement Code in an effort to identify areas for improvement that increase diversity and inclusion.

(c) The Task Force may request testimony from any person or entity that may assist in increasing understanding or solution-based ideologies that will improve representation and opportunities for minorities, women, persons with disabilities, and LGBTQ+ persons within business entities and State procurement.

(d) The Task Force shall consist of the following members:

(1) the Secretary of State, or his or her designee, who shall be the Chair of the Task Force;

(2) one member of the House of Representatives appointed by the Speaker of the House of Representatives;

(3) one member of the House of Representatives appointed by the Minority Leader of the House of Representatives;

(4) one member of the Senate appointed by the President of the Senate;

(5) one member of the Senate appointed by the Minority Leader of the Senate;

(6) two chief procurement officers of a State agency, appointed by the Governor; and

(7) five members representing women-owned businesses, businesses owned by a person with disability, minority-owned businesses, LGBTQ+-owned businesses, appointed one each by the Governor, the Speaker of the House of Representatives, the President of the Senate, the Minority Leader of the House of Representatives, and the Minority Leader of the Senate.

(e) Members of the Task Force shall serve without compensation for the duration of the Task Force, but they may be reimbursed for reasonable travel expenses and in compliance with the Secretary of State travel rules required for attendance at meetings. Vacancies in the Task Force shall be filled by the original appointing authority.

(f) As soon as practicable, but no later than September 1, 2025, all members shall be appointed to the Task Force. As soon as practicable after all members have been appointed, the Task Force shall hold its first meeting. The Task Force shall hold at least 5 meetings.

(g) The Office of the Secretary of State shall provide administrative and other support to the Task Force.

(h) The Task Force shall from time to time submit reports of its findings and recommendations on its work to the Governor and the General Assembly. By January 1, 2027, the Task Force shall submit a final report to the Governor and General Assembly containing its findings and recommendations.

(i) This Section is repealed on January 1, 2028.

Section 99. Effective date. This Act takes effect upon becoming law.
