SYNOPSIS AS INTRODUCED:

20 ILCS 1405/1405-55 new

Amends the Department of Insurance Law of the Civil Administrative Code of Illinois. Creates the Public Adjuster Advisory Board within the Department of Insurance. Provides that the Board shall review and recommend changes to the licensure, license issuance, and requirements for licensed public adjusters in the State. Provides that the Board shall also prepare rules that may be adopted by the Department to protect commercial and residential consumers in situations where a catastrophic event has taken place. Sets forth provisions concerning membership, compensation, administrative support, and meetings. Provides that, no later than January 1, 2026, and each year thereafter, the Board shall submit a report to the Governor and the General Assembly concerning any issues relating to the licensing and operations of public adjusters in the State and any recommend policy changes to address those issues. Effective immediately.

A BILL FOR

AN ACT concerning State Government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Department of Insurance Law of the Civil Administrative Code of Illinois is amended by adding Section 1405-55 as follows:

(20 ILCS 1405/1405-55 new)

Sec. 1405-55. Public Adjuster Advisory Board.

(a) The Public Adjuster Advisory Board is created within the Department of Insurance. The Board shall review and recommend changes to the licensure, license issuance, and requirements for licensed public adjusters in this State. The Board shall also adopt advisory recommendations, which may include proposed rules, for consideration by the Department as necessary to protect commercial and residential consumers in situations where a catastrophic event has taken place.

(b) The Board shall consist of the following members:

(1) the Director of Insurance or the Director's designee, who shall serve as the chairperson of the Board;

(2) the Chief Enforcement Officer of the Department of Insurance or the Chief Enforcement Officer's designee;

(3) the General Counsel of the Department of Insurance or the General Counsel's designee;

(4) one member appointed by the President of the Senate;

(5) one member appointed by the Minority Leader of the Senate;

(6) one member appointed by the Speaker of the House of Representatives;

(7) one member appointed by the Minority Leader of the House of Representatives;

(8) one licensed attorney who specializes in the regulation of public adjusters in Illinois, appointed the Governor;

(9) one public adjuster residing outside of Cook County, DuPage County, Kane County, Lake County, McHenry County, and Will County, appointed the Governor;

(10) 2 licensed public adjusters residing in Cook County, DuPage County, Kane County, Lake County, McHenry County, and Will County, appointed the Governor; and

(11) 2 licensed public adjusters representing the Chicagoland Public Adjusters Association, appointed the Governor.

(c) Members shall receive no compensation, but they may be reimbursed for necessary expenses from appropriations to the Department of Insurance available for that purpose.

(d) The Department of Insurance shall provide staff and administrative assistance to the Board.

(e) The Board shall meet as soon as practicable after the appointments are made to the Board. The Board shall meet in April and September of each year thereafter.

(f) No later than January 1, 2026, and each year thereafter, the Board shall submit a report to the Governor and the General Assembly concerning any issues relating to the licensing and operations of public adjusters in this State and any recommend policy changes to address those issues.

Section 99. Effective date. This Act takes effect upon becoming law.
