Synopsis As Introduced
Amends the Criminal Code of 1961 and the Unified Code of Corrections. Requires a mandatory sentence of imprisonment for certain violations of the statutes concerning unlawful use of weapons, the unlawful use or possession of weapons by felons, and aggravated unlawful use of a weapon. Provides that a period of probation, periodic imprisonment, or conditional discharge may not be imposed for these violations.

 Fiscal Note (Dept of Corrections)
 This legislation would result in prison sentences for some offenders who would receive probation or another community sanction under the current statutes. These enhancements would result in an increase of 920 inmates with $237,104,600 in additional costs over the first ten years after enactment.

Senate Floor Amendment No. 1
Provides that the mandatory prison sentence for unlawful use or possession of weapons by felons who are not confined in a penal institution who have been convicted of a forcible felony only applies to forcible felonies committed within 10 years of the date on which the person committed the offense for which the person is being sentenced, excluding time served in custody.
