Synopsis As Introduced
Amends the Code of Civil Procedure. Exempts from the application of the statutes of limitation and repose governing civil actions arising out of acts or omissions in the design, planning, supervision, observation, management, and construction of or improvement to real property those actions that are based on personal injury, bodily harm, or death resulting from the discharge into the environment of any pollutant, including any waste, hazardous substance, irritant, or contaminant. Prohibits a person in actual possession or control of an improvement to real property from raising those statutes of limitations and repose when any defect in that improvement results in the injury or death for which an action is proposed to be brought. Effective immediately.

House Floor Amendment No. 1
Provides that language prohibiting an action based on an act or omission in the design, planning, supervision, observation or management of construction, or construction of an improvement to real property after 10 years have elapsed (rather than all language limiting civil actions relating to design, planning, supervision, observation or management of construction, or construction of an improvement to real property) does not apply to actions that are based on personal injury, bodily harm, or death resulting from specified environmental discharges. Deletes language prohibiting a person in actual possession or control of an improvement to real property from raising those statutes of limitations and repose when any defect in that improvement results in the injury or death for which an action is proposed to be brought.
