AMENDMENT TO SENATE BILL 1559

2    AMENDMENT NO. ______. Amend Senate Bill 1559 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Transportation Law of the
5Civil Administrative Code of Illinois is amended by changing
6Section 2705-210 as follows:
 
7    (20 ILCS 2705/2705-210)  (was 20 ILCS 2705/49.15)
8    Sec. 2705-210. Traffic control and prevention of crashes.
9    (a) The Department has the power to develop, consolidate,
10and coordinate effective programs and activities for the
11advancement of driver education, for the facilitation of the
12movement of motor vehicle traffic, and for the protection and
13conservation of life and property on the streets and highways
14of this State and to advise, recommend, and consult with the
15several departments, divisions, boards, commissions, and other
16agencies of this State in regard to those programs and

1activities. The Department has the power to aid and assist the
2counties, cities, towns, and other political subdivisions of
3this State in the control of traffic and the prevention of
4traffic crashes. That aid and assistance to counties, cities,
5towns, and other political subdivisions of this State shall
6include assistance with regard to planning, traffic flow,
7light synchronizing, preferential lanes for carpools, and
8carpool parking allocations.
9    (b) To further the prevention of crashes, the Department
10shall conduct a traffic study following the occurrence of any
11crash involving a pedestrian fatality that occurs at an
12intersection of a State or municipal highway. If a memorandum
13of understanding exists between the State and municipal
14departments of transportation and that memorandum of
15understanding requires that the 2 bodies meet monthly or
16regularly, the meeting agendas shall include, but not be
17limited to, integrated discussion of the fatality reports that
18each municipal or State department of transportation has
19conducted and how to address these crashes. Nothing in this
20Section limits local law enforcement or the Illinois State
21Police from participation. The discussion study shall include,
22but not be limited to, consideration of alternative geometric
23design improvements, traffic control devices, and any other
24improvements that both departments deem the Department deems
25necessary to reduce traffic crashes and fatalities. The
26Department shall make the results of the study available to

1the public on its website.
2    (c) The Department shall conduct a timely analysis of each
3fatal traffic crash that occurs on a State or municipal
4highway that is reported to the Illinois State Police or a
5local law enforcement agency. The purpose of the analyses is
6to understand the circumstances associated with the traffic
7crashes.
8    (d) The Department shall conduct periodic analyses to
9identify trends, patterns, and correlations associated with
10traffic crashes, including, but not limited to, trends,
11patterns, and correlations associated with the occurrence of
12fatal or serious injury traffic crash outcomes in population
13groups, such as pedestrians and bicyclists, or locations
14disproportionately impacted by fatal traffic crash outcomes.
15    (e) Based on its analyses, the Department shall identify
16potential actions to increase traffic safety, which may
17include, but are not limited to, modifications to street
18design and infrastructure. When appropriate, the discussions
19shall include estimates for the cost of implementation and
20potential funding options in its identification of such
21potential actions.
22    (f) In conducting analyses and in identifying potential
23actions, the Department shall coordinate with any other
24department, agency, or organization deemed relevant by the
25Department.
26    (g) Each department, including State and municipal

1departments, of transportation shall make the reports of the
2analysis and results of the study available to the public upon
3request.
