| 8 | follows: | ||||||
| 9 | (20 ILCS 605/605-625) (was 20 ILCS 605/46.25) | ||||||
| 10 | Sec. 605-625. Promotion of water ports and airport | ||||||
| 11 | facilities. In cooperation with the Department of Agriculture | ||||||
| 12 | and the International Trade and Port Promotion Advisory | ||||||
| 13 | Committee, to (i) establish a freight rate information service | ||||||
| 14 | for U.S. and foreign shippers; (ii) promote the advantages of | ||||||
| 15 | Illinois water ports and existing airport facilities through | ||||||
| 16 | appropriate means and media in this country and overseas; and | ||||||
| |||||||
| |||||||
| 1 | (ii) (iii) cooperate with the export expansion projects and | ||||||
| 2 | any other activity that results in the additional flow of | ||||||
| 3 | agricultural and manufactured products through the Illinois | ||||||
| 4 | water ports and existing airport facilities. | ||||||

| 6 | (20 ILCS 605/605-940) (was 20 ILCS 605/46.37) | ||||||
| 7 | Sec. 605-940. Clearing house for local government | ||||||
| 8 | problems; aid with financial and administrative matters. The | ||||||
| 9 | Department shall provide for a central clearing house for | ||||||
| 10 | information concerning local government problems and various | ||||||
| 11 | solutions to those problems and shall assist and aid local | ||||||
| 12 | governments of the State in matters relating to budgets, | ||||||
| 13 | fiscal procedures, and administration. In performing this | ||||||
| 14 | responsibility the Department shall have the power and duty to | ||||||
| 15 | do the following: | ||||||
| 16 | (1) Maintain communication with all local governments | ||||||
| 17 | and assist them, at their request, to improve their | ||||||
| 18 | administrative procedures and to facilitate improved local | ||||||
| 19 | government and development. | ||||||
| 20 | (2) Assemble and disseminate information concerning | ||||||
| 21 | State and federal programs, grants, gifts, and subsidies | ||||||
| 22 | available to local governments and to provide counsel and | ||||||
| 23 | technical services and other assistance in applying for | ||||||
| 24 | those programs, grants, gifts, and subsidies. | ||||||
| 25 | (3) Assist in coordinating activities by obtaining | ||||||
| |||||||
| |||||||
| 1 | information, on forms provided by the Department or by | ||||||
| 2 | receipt of proposals and applications, concerning State | ||||||
| 3 | and federal assisted programs, grants, gifts, and | ||||||
| 4 | subsidies applied for and received by all local | ||||||
| 5 | governments. | ||||||
| 6 | (4) Provide direct consultative services to local | ||||||
| 7 | governments upon request and provide staff services to | ||||||
| 8 | special commissions, the Governor, or the General Assembly | ||||||
| 9 | or its committees. | ||||||
| 10 | (5) Render advice and assistance with respect to the | ||||||
| 11 | establishment and maintenance of programs for the training | ||||||
| 12 | of local government officials and other personnel. | ||||||
| 13 | (6) Act as the official State agency for the receipt | ||||||
| 14 | and distribution of federal funds that are or may be | ||||||
| 15 | provided to the State on a flat grant basis for | ||||||
| 16 | distribution to local governments or in the event federal | ||||||
| 17 | law requires a State agency to implement programs | ||||||
| 18 | affecting local governments and for State funds that are | ||||||
| 19 | or may be provided for the use of local governments unless | ||||||
| 20 | otherwise provided by law. | ||||||
| 21 | (7) Administer laws relating to local government | ||||||
| 22 | affairs as the General Assembly may direct. | ||||||
| 23 | (8) Provide all advice and assistance to improve local | ||||||
| 24 | government administration, ensure the economical and | ||||||
| 25 | efficient provision of local government services, and make | ||||||
| 26 | the Civil Administrative Code of Illinois effective. | ||||||
| |||||||
| |||||||
| 1 | (9) Give advice and counsel on fiscal problems of | ||||||
| 2 | local governments of the State to those local governments. | ||||||
| 3 | (10) (Blank). Prepare uniform budgetary forms for use | ||||||
| 4 | by the local governments of the State. | ||||||
| 5 | (11) (Blank). Assist and advise the local governments | ||||||
| 6 | of the State in matters pertaining to budgets, | ||||||
| 7 | appropriation requests and ordinances, the determination | ||||||
| 8 | of property tax levies and rates, and other matters of a | ||||||

| 20 | following, and receive and disburse State and federal | ||||||
| 21 | funds provided for that program and moneys received as | ||||||
| 22 | repayments of loans made under the program. | ||||||
| 23 | (16) (Blank). After January 1, 1985, upon the request | ||||||
| 24 | of local governments, prepare and provide model financial | ||||||
| 25 | statement forms designed to communicate to taxpayers, | ||||||
| 26 | service consumers, voters, government employees, and news | ||||||
| |||||||
| |||||||
| 1 | media, in a non-technical manner, all significant | ||||||
| 2 | financial information regarding a particular local | ||||||
| 3 | government, and to prepare and provide to local | ||||||
| 4 | governments a summary of local governments' obligations | ||||||
| 5 | concerning the adoption of an annual operating budget. The | ||||||
| 6 | summary shall be set forth in a non-technical manner and | ||||||
| 7 | shall be designed principally for distribution to, and the | ||||||
| 8 | use of, taxpayers, service consumers, voters, government | ||||||
| 9 | employees, and news media. | ||||||

| 21 | Section 20. The Eliminate the Digital Divide Law is | ||||||
| 22 | amended by changing Sections 5-5, 5-30, and 5-45 and by adding | ||||||
| |||||||
| |||||||
| 1 | Section 5-30.1 as follows: | ||||||
| 2 | (30 ILCS 780/5-5) | ||||||
| 3 | Sec. 5-5. Definitions; descriptions. As used in this | ||||||
| 4 | Article: | ||||||
| 5 | "Community-based organization" means a private | ||||||
| 6 | not-for-profit organization that is located in an Illinois | ||||||
| 7 | community and that provides services to citizens within that | ||||||
| 8 | community and the surrounding area. | ||||||
| 9 | "Covered population" means individuals who live in covered | ||||||
| 10 | households, including aging individuals, veterans, individuals | ||||||
| 11 | with disabilities, individuals with a language barrier | ||||||
| 12 | (including those who are English learners and have low levels | ||||||
| 13 | of literacy), members of racial or ethnic minority groups, and | ||||||
| 14 | individuals who primarily reside in a rural area. "Covered | ||||||
| 15 | population" also includes incarcerated individuals (other than | ||||||
| 16 | those incarcerated in a federal correctional facility), | ||||||
| 17 | including all justice-impacted and system-impacted | ||||||
| 18 | individuals. | ||||||
| 19 | "Digital navigator program" means a program in which | ||||||
| 20 | designated volunteers or staff of an organization offer | ||||||
| 21 | technical assistance to support broadband adoption, digital | ||||||
| 22 | skill building, and the use of devices. | ||||||
| 23 | "Senior citizen home" means an Illinois-based residential | ||||||
| 24 | facility for people who are over the age of 65. The term | ||||||
| 25 | "senior citizen home" includes, but is not limited to, | ||||||
| |||||||
| |||||||
| 1 | convalescent homes, long-term care facilities, assistive | ||||||
| 2 | living facilities, and nursing homes. | ||||||
| 3 | "Community technology centers" provide computer access and | ||||||
| 4 | educational services using information technology. Community | ||||||
| 5 | technology centers are diverse in the populations they serve | ||||||
| 6 | and programs they offer, but similar in that they provide | ||||||
| 7 | technology access to individuals, communities, and populations | ||||||
| 8 | that typically would not otherwise have places to use computer | ||||||
| 9 | and telecommunications technologies. | ||||||
| 10 | "Department" means the Department of Commerce and Economic | ||||||
| 11 | Opportunity. | ||||||
| 12 | "National school lunch program" means a program | ||||||
| 13 | administered by the U.S. Department of Agriculture and state | ||||||
| 14 | agencies that provides free or reduced price lunches to | ||||||
| 15 | economically disadvantaged children. A child whose family | ||||||
| 16 | income is between 130% and 185% of applicable family size | ||||||
| 17 | income levels contained in the nonfarm poverty guidelines | ||||||
| 18 | prescribed by the Office of Management and Budget is eligible | ||||||
| 19 | for a reduced price lunch. A child whose family income is 130% | ||||||
| 20 | or less of applicable family size income levels contained in | ||||||
| 21 | the nonfarm income poverty guidelines prescribed by the Office | ||||||
| 22 | of Management and Budget is eligible for a free lunch. | ||||||
| 23 | "Telecommunications services" provided by | ||||||
| 24 | telecommunications carriers include all commercially available | ||||||
| 25 | telecommunications services in addition to all reasonable | ||||||
| 26 | charges that are incurred by taking such services, such as | ||||||
| |||||||
| |||||||
| 1 | state and federal taxes. | ||||||
| 2 | "Other special services" provided by telecommunications | ||||||
| 3 | carriers include Internet access and installation and | ||||||
| 4 | maintenance of internal connections in addition to all | ||||||
| 5 | reasonable charges that are incurred by taking such services, | ||||||
| 6 | such as state and federal taxes. | ||||||

| 8 | (30 ILCS 780/5-30) | ||||||
| 9 | Sec. 5-30. Community Technology Center Grant Program. | ||||||
| 10 | (a) Subject to appropriation, the Department shall | ||||||
| 11 | administer the Community Technology Center Grant Program under | ||||||
| 12 | which the Department shall make grants in accordance with this | ||||||
| 13 | Article for planning, establishment, administration, and | ||||||
| 14 | expansion of Community Technology Centers and for assisting | ||||||
| 15 | public hospitals, libraries, and park districts in eliminating | ||||||
| 16 | the digital divide. The purposes of the grants shall include, | ||||||
| 17 | but not be limited to, volunteer recruitment and management, | ||||||
| 18 | training and instruction, infrastructure, and related goods | ||||||
| 19 | and services, including case management, administration, | ||||||
| 20 | personal information management, and outcome-tracking tools | ||||||
| 21 | and software for the purposes of reporting to the Department | ||||||
| 22 | and for enabling participation in digital government and | ||||||
| 23 | consumer services programs, for Community Technology Centers | ||||||
| 24 | and public hospitals, libraries, and park districts. No | ||||||
| 25 | Community Technology Center may receive a grant of more than | ||||||
| |||||||
| |||||||
| 1 | $75,000 under this Section in a particular fiscal year. | ||||||
| 2 | (b) Public hospitals, libraries, park districts, and State | ||||||
| 3 | educational agencies, local educational agencies, institutions | ||||||
| 4 | of higher education, senior citizen homes, and other public | ||||||
| 5 | and private nonprofit or for-profit agencies and organizations | ||||||
| 6 | are eligible to receive grants under this Program, provided | ||||||
| 7 | that a local educational agency or public or private | ||||||
| 8 | educational agency or organization must, in order to be | ||||||
| 9 | eligible to receive grants under this Program, provide | ||||||
| 10 | computer access and educational services using information | ||||||
| 11 | technology to the public at one or more of its educational | ||||||
| 12 | buildings or facilities at least 12 hours each week. A group of | ||||||
| 13 | eligible entities is also eligible to receive a grant if the | ||||||
| 14 | group follows the procedures for group applications in 34 CFR | ||||||
| 15 | 75.127-129 of the Education Department General Administrative | ||||||
| 16 | Regulations. | ||||||
| 17 | To be eligible to apply for a grant, a Community | ||||||
| 18 | Technology Center must serve a covered population or a | ||||||
| 19 | community in which not less than 40% of the students are | ||||||
| 20 | eligible for a free or reduced price lunch under the national | ||||||
| 21 | school lunch program or in which not less than 30% of the | ||||||
| 22 | students are eligible for a free lunch under the national | ||||||
| 23 | school lunch program; however, if funding is insufficient to | ||||||
| 24 | approve all grant applications for a particular fiscal year, | ||||||
| 25 | the Department may impose a higher minimum percentage | ||||||
| 26 | threshold for that fiscal year. Determinations of communities | ||||||
| |||||||
| |||||||
| 1 | and determinations of the percentage of students in a | ||||||
| 2 | community who are eligible for a free or reduced price lunch | ||||||
| 3 | under the national school lunch program shall be in accordance | ||||||
| 4 | with rules adopted by the Department. | ||||||
| 5 | Any entities that have received a Community Technology | ||||||
| 6 | Center grant under the federal Community Technology Centers | ||||||
| 7 | Program are also eligible to apply for grants under this | ||||||
| 8 | Program. | ||||||
| 9 | The Department shall provide assistance to Community | ||||||
| 10 | Technology Centers in making those determinations for purposes | ||||||
| 11 | of applying for grants. | ||||||
| 12 | The Department shall encourage Community Technology | ||||||
| 13 | Centers to participate in public and private computer hardware | ||||||
| 14 | equipment recycling initiatives that provide computers at | ||||||
| 15 | reduced or no cost to low-income families, including programs | ||||||
| 16 | authorized by the State Property Control Act. On an annual | ||||||
| 17 | basis, the Department must provide the Director of Central | ||||||
| 18 | Management Services with a list of Community Technology | ||||||
| 19 | Centers that have applied to the Department for funding as | ||||||
| 20 | potential recipients of surplus State-owned computer hardware | ||||||
| 21 | equipment under programs authorized by the State Property | ||||||
| 22 | Control Act. | ||||||
| 23 | (c) Grant applications shall be submitted to the | ||||||
| 24 | Department on a schedule of one or more deadlines established | ||||||
| 25 | by the Department by rule. | ||||||
| 26 | (d) The Department shall adopt rules setting forth the | ||||||
| |||||||
| |||||||
| 1 | required form and contents of grant applications. | ||||||
| 2 | (e) (Blank). | ||||||
| 3 | (f) (Blank). | ||||||
| 4 | (g) Duties of the Digital Divide Elimination Working Group | ||||||
| 5 | include all of the following: | ||||||
| 6 | (1) Undertaking a thorough review of grant programs | ||||||
| 7 | available through the federal government, local agencies, | ||||||
| 8 | telecommunications providers, and business and charitable | ||||||
| 9 | entities for the purpose of identifying appropriate | ||||||
| 10 | sources of revenues for the Digital Divide Elimination | ||||||
| 11 | Fund and attempting to update available grants on a | ||||||
| 12 | regular basis. | ||||||
| 13 | (2) Researching and cataloging programs designed to | ||||||
| 14 | advance digital literacy and computer access that are | ||||||
| 15 | available through the federal government, local agencies, | ||||||
| 16 | telecommunications providers, and business and charitable | ||||||
| 17 | entities and attempting to update available programs on a | ||||||
| 18 | regular basis. | ||||||
| 19 | (3) Presenting the information compiled from items (1) | ||||||
| 20 | and (2) to the Department of Commerce and Economic | ||||||
| 21 | Opportunity, which shall serve as a single point of | ||||||
| 22 | contact for applying for funding for the Digital Divide | ||||||
| 23 | Elimination Fund and for distributing information to the | ||||||
| 24 | public regarding all programs designed to advance digital | ||||||
| 25 | literacy and computer access. | ||||||

| 1 | (30 ILCS 780/5-30.1 new) | ||||||
| 2 | Sec. 5-30.1. Digital Divide Elimination Fund. Funds made | ||||||
| 3 | available through the Digital Divide Elimination Fund shall | ||||||
| 4 | also be used to make grants that further the State's digital | ||||||
| 5 | equity vision in which: | ||||||
| 6 | (1) all Illinoisans are empowered to use and | ||||||
| 7 | participate fully in an increasingly digital economy and | ||||||
| 8 | society through universal access to high-speed broadband | ||||||
| 9 | that is affordable, reliable, and fully scalable; | ||||||
| 10 | (2) new and existing resources are used to implement | ||||||
| 11 | targeted digital inclusion strategies and sustainable | ||||||
| 12 | broadband equity outcomes; and | ||||||
| 13 | (3) all Illinoisans are empowered to use and | ||||||
| 14 | participate fully in an increasingly digital economy and | ||||||
| 15 | society. | ||||||
| 16 | Examples of digital inclusion strategies include, but are | ||||||
| 17 | not limited to, establishing digital navigator programs, | ||||||
| 18 | programs that provide digital literacy and digital skills | ||||||
| 19 | training, computer refurbishment programs, and device | ||||||
| 20 | distribution programs. | ||||||
| 21 | Grants under this Section shall be distributed to public | ||||||
| 22 | hospitals, libraries, park districts, State agencies, local | ||||||
| 23 | agencies, institutions of higher education, senior citizens | ||||||
| 24 | homes, and other public and private nonprofit agencies and | ||||||
| 25 | organizations that serve one or more of the covered | ||||||
| |||||||
| |||||||
| 1 | populations. | ||||||
| 2 | Grant applications under this Section shall be submitted | ||||||
| 3 | to the Department. | ||||||
| 4 | The Department may adopt rules concerning grant | ||||||
| 5 | applications under this Section. | ||||||
| 6 | (30 ILCS 780/5-45) | ||||||
| 7 | Sec. 5-45. Statewide Community Technology Center Network. | ||||||
| 8 | (a) Subject to appropriation, the Department shall expend | ||||||
| 9 | not more than $100,000 in fiscal year 2001 to establish and | ||||||
| 10 | administer a Statewide Community Technology Center Network to | ||||||
| 11 | assist in local and regional planning under this Article. | ||||||
| 12 | (b) Subject to appropriation, the Department may expend | ||||||
| 13 | not more than $100,000 in fiscal year 2006 and each fiscal year | ||||||
| 14 | thereafter to establish and administer a Statewide Community | ||||||
| 15 | Technology Center Network and public facing data source that | ||||||
| 16 | serves as a digital hub for mapping, data collection, and | ||||||
| 17 | program evaluation to assist in local and regional planning | ||||||
| 18 | and revenue development and outreach under this Article. | ||||||

| 20 | Section 25. The Music and Musicians Tax Credit and Jobs | ||||||
| 21 | Act is amended by changing Section 50-45 as follows: | ||||||
| 22 | (35 ILCS 19/50-45) | ||||||
| 23 | Sec. 50-45. Qualified music program evaluation and | ||||||
| |||||||
| |||||||
| 1 | reports. | ||||||
| 2 | (a) (Blank). | ||||||
| 3 | The Department may make a recommendation to extend, | ||||||
| 4 | modify, or not extend the program based on the evaluation. | ||||||
| 5 | (b) (Blank). At the end of each fiscal quarter, the | ||||||
| 6 | Department shall submit to the General Assembly a report that | ||||||
| 7 | includes, without limitation: | ||||||
| 8 | (1) an assessment of the economic impact of the | ||||||
| 9 | program, including the number of jobs created and | ||||||
| 10 | retained, and whether the job positions are entry level, | ||||||
| 11 | management, vendor, or production related; | ||||||
| 12 | (2) the amount of qualified music company spending | ||||||
| 13 | brought to Illinois, including the amount of spending and | ||||||
| 14 | type of Illinois vendors hired in connection with a | ||||||
| 15 | qualified music company; and | ||||||
| 16 | (3) a determination of whether those receiving | ||||||
| 17 | qualifying Illinois labor expenditure salaries or wages | ||||||
| 18 | reflect the geographic, racial and ethnic, gender, and | ||||||
| 19 | income level diversity of the State of Illinois. | ||||||
| 20 | (c) At the end of each fiscal year, the Department shall | ||||||
| 21 | submit to the General Assembly a report that includes, without | ||||||
| 22 | limitation: | ||||||
| 23 | (1) the identification of each vendor that provided | ||||||
| 24 | goods or services that were included in a qualified music | ||||||
| 25 | company's Illinois spending; | ||||||
| 26 | (2) a statement of the amount paid to each identified | ||||||
| |||||||
| |||||||
| 1 | vendor by the qualified music program and whether the | ||||||
| 2 | vendor is a minority-owned or women-owned business as | ||||||
| 3 | defined in Section 2 of the Business Enterprise for | ||||||
| 4 | Minorities, Women, and Persons with Disabilities Act; and | ||||||
| 5 | (3) a description of the steps taken by the Department | ||||||
| 6 | to encourage qualified music companies to use vendors who | ||||||
| 7 | are minority-owned or women-owned businesses. | ||||||

| 9 | Section 27. The Illinois Public Aid Code is amended by | ||||||
| 10 | changing Sections 4-2 and 6-2 as follows: | ||||||
| 11 | (305 ILCS 5/4-2) (from Ch. 23, par. 4-2) | ||||||
| 12 | Sec. 4-2. Amount of aid. | ||||||
| 13 | (a) The amount and nature of financial aid shall be | ||||||
| 14 | determined in accordance with the grant amounts, rules and | ||||||
| 15 | regulations of the Illinois Department. Due regard shall be | ||||||
| 16 | given to the self-sufficiency requirements of the family and | ||||||
| 17 | to the income, money contributions and other support and | ||||||
| 18 | resources available, from whatever source. However, the amount | ||||||
| 19 | and nature of any financial aid is not affected by the payment | ||||||
| 20 | of any grant under the "Senior Citizens and Persons with | ||||||
| 21 | Disabilities Property Tax Relief Act" or any distributions or | ||||||
| 22 | items of income described under subparagraph (X) of paragraph | ||||||
| 23 | (2) of subsection (a) of Section 203 of the Illinois Income Tax | ||||||
| 24 | Act. The aid shall be sufficient, when added to all other | ||||||
| |||||||
| |||||||
| 1 | income, money contributions and support to provide the family | ||||||
| 2 | with a grant in the amount established by Department | ||||||
| 3 | regulation. | ||||||
| 4 | (a-5) For the purposes of this subsection, TANF grant | ||||||
| 5 | amounts shall consist of the following portions: | ||||||
| 6 | (1) 75% shall be designated for the child or children | ||||||
| 7 | of the assistance unit; and | ||||||
| 8 | (2) 25% shall be designated for the adult member or | ||||||
| 9 | members of the assistance unit. | ||||||
| 10 | (b) The Illinois Department may conduct special projects, | ||||||
| 11 | which may be known as Grant Diversion Projects, under which | ||||||
| 12 | recipients of financial aid under this Article are placed in | ||||||
| 13 | jobs and their grants are diverted to the employer who in turn | ||||||
| 14 | makes payments to the recipients in the form of salary or other | ||||||
| 15 | employment benefits. The Illinois Department shall by rule | ||||||
| 16 | specify the terms and conditions of such Grant Diversion | ||||||
| 17 | Projects. Such projects shall take into consideration and be | ||||||
| 18 | coordinated with the programs administered under the Illinois | ||||||
| 19 | Emergency Employment Development Act. | ||||||
| 20 | (c) The amount and nature of the financial aid for a child | ||||||
| 21 | requiring care outside his own home shall be determined in | ||||||
| 22 | accordance with the rules and regulations of the Illinois | ||||||
| 23 | Department, with due regard to the needs and requirements of | ||||||
| 24 | the child in the foster home or institution in which he has | ||||||
| 25 | been placed. | ||||||
| 26 | (d) If the Department establishes grants for family units | ||||||
| |||||||
| |||||||
| 1 | consisting exclusively of a pregnant woman with no dependent | ||||||
| 2 | child or including her husband if living with her, the grant | ||||||
| 3 | amount for such a unit shall be equal to the grant amount for | ||||||
| 4 | an assistance unit consisting of one adult, or 2 persons if the | ||||||
| 5 | husband is included. Other than as herein described, an unborn | ||||||
| 6 | child shall not be counted in determining the size of an | ||||||
| 7 | assistance unit or for calculating grants. | ||||||
| 8 | Payments for basic maintenance requirements of a child or | ||||||
| 9 | children and the relative with whom the child or children are | ||||||
| 10 | living shall be prescribed, by rule, by the Illinois | ||||||
| 11 | Department. | ||||||
| 12 | Grants under this Article shall not be supplemented by | ||||||
| 13 | General Assistance provided under Article VI. | ||||||
| 14 | (e) Grants shall be paid to the parent or other person with | ||||||
| 15 | whom the child or children are living, except for such amount | ||||||
| 16 | as is paid in behalf of the child or his parent or other | ||||||
| 17 | relative to other persons or agencies pursuant to this Code or | ||||||
| 18 | the rules and regulations of the Illinois Department. | ||||||
| 19 | (f) Subject to subsection (f-5), an assistance unit, | ||||||
| 20 | receiving financial aid under this Article or temporarily | ||||||
| 21 | ineligible to receive aid under this Article under a penalty | ||||||
| 22 | imposed by the Illinois Department for failure to comply with | ||||||
| 23 | the eligibility requirements or that voluntarily requests | ||||||
| 24 | termination of financial assistance under this Article and | ||||||
| 25 | becomes subsequently eligible for assistance within 9 months, | ||||||
| 26 | shall not receive any increase in the amount of aid solely on | ||||||
| |||||||
| |||||||
| 1 | account of the birth of a child; except that an increase is not | ||||||
| 2 | prohibited when the birth is (i) of a child of a pregnant woman | ||||||
| 3 | who became eligible for aid under this Article during the | ||||||
| 4 | pregnancy, or (ii) of a child born within 10 months after the | ||||||
| 5 | date of implementation of this subsection, or (iii) of a child | ||||||
| 6 | conceived after a family became ineligible for assistance due | ||||||
| 7 | to income or marriage and at least 3 months of ineligibility | ||||||
| 8 | expired before any reapplication for assistance. This | ||||||
| 9 | subsection does not, however, prevent a unit from receiving a | ||||||
| 10 | general increase in the amount of aid that is provided to all | ||||||
| 11 | recipients of aid under this Article. | ||||||
| 12 | The Illinois Department is authorized to transfer funds, | ||||||
| 13 | and shall use any budgetary savings attributable to not | ||||||
| 14 | increasing the grants due to the births of additional | ||||||
| 15 | children, to supplement existing funding for employment and | ||||||
| 16 | training services for recipients of aid under this Article IV. | ||||||
| 17 | The Illinois Department shall target, to the extent the | ||||||
| 18 | supplemental funding allows, employment and training services | ||||||
| 19 | to the families who do not receive a grant increase after the | ||||||
| 20 | birth of a child. In addition, the Illinois Department shall | ||||||
| 21 | provide, to the extent the supplemental funding allows, such | ||||||
| 22 | families with up to 24 months of transitional child care | ||||||
| 23 | pursuant to Illinois Department rules. All remaining | ||||||
| 24 | supplemental funds shall be used for employment and training | ||||||
| 25 | services or transitional child care support. | ||||||
| 26 | In making the transfers authorized by this subsection, the | ||||||
| |||||||
| |||||||
| 1 | Illinois Department shall first determine, pursuant to | ||||||
| 2 | regulations adopted by the Illinois Department for this | ||||||
| 3 | purpose, the amount of savings attributable to not increasing | ||||||
| 4 | the grants due to the births of additional children. Transfers | ||||||
| 5 | may be made from General Revenue Fund appropriations for | ||||||
| 6 | distributive purposes authorized by Article IV of this Code | ||||||
| 7 | only to General Revenue Fund appropriations for employability | ||||||
| 8 | development services including operating and administrative | ||||||
| 9 | costs and related distributive purposes under Article IXA of | ||||||
| 10 | this Code. The Director, with the approval of the Governor, | ||||||
| 11 | shall certify the amount and affected line item appropriations | ||||||
| 12 | to the State Comptroller. | ||||||
| 13 | Nothing in this subsection shall be construed to prohibit | ||||||
| 14 | the Illinois Department from using funds under this Article IV | ||||||
| 15 | to provide assistance in the form of vouchers that may be used | ||||||
| 16 | to pay for goods and services deemed by the Illinois | ||||||
| 17 | Department, by rule, as suitable for the care of the child such | ||||||
| 18 | as diapers, clothing, school supplies, and cribs. | ||||||
| 19 | (f-5) Subsection (f) shall not apply to affect the monthly | ||||||
| 20 | assistance amount of any family as a result of the birth of a | ||||||
| 21 | child on or after January 1, 2004. As resources permit after | ||||||
| 22 | January 1, 2004, the Department may cease applying subsection | ||||||
| 23 | (f) to limit assistance to families receiving assistance under | ||||||
| 24 | this Article on January 1, 2004, with respect to children born | ||||||
| 25 | prior to that date. In any event, subsection (f) shall be | ||||||
| 26 | completely inoperative on and after July 1, 2007. | ||||||

| 1 | (g) (Blank). | ||||||
| 2 | (h) Notwithstanding any other provision of this Code, the | ||||||
| 3 | Illinois Department is authorized to reduce payment levels | ||||||
| 4 | used to determine cash grants under this Article after | ||||||
| 5 | December 31 of any fiscal year if the Illinois Department | ||||||
| 6 | determines that the caseload upon which the appropriations for | ||||||
| 7 | the current fiscal year are based have increased by more than | ||||||
| 8 | 5% and the appropriation is not sufficient to ensure that cash | ||||||
| 9 | benefits under this Article do not exceed the amounts | ||||||
| 10 | appropriated for those cash benefits. Reductions in payment | ||||||
| 11 | levels may be accomplished by emergency rule under Section | ||||||
| 12 | 5-45 of the Illinois Administrative Procedure Act, except that | ||||||
| 13 | the limitation on the number of emergency rules that may be | ||||||
| 14 | adopted in a 24-month period shall not apply and the | ||||||
| 15 | provisions of Sections 5-115 and 5-125 of the Illinois | ||||||
| 16 | Administrative Procedure Act shall not apply. Increases in | ||||||
| 17 | payment levels shall be accomplished only in accordance with | ||||||
| 18 | Section 5-40 of the Illinois Administrative Procedure Act. | ||||||
| 19 | Before any rule to increase payment levels promulgated under | ||||||
| 20 | this Section shall become effective, a joint resolution | ||||||
| 21 | approving the rule must be adopted by a roll call vote by a | ||||||
| 22 | majority of the members elected to each chamber of the General | ||||||
| 23 | Assembly. | ||||||

| 1 | Sec. 6-2. Amount of aid. The amount and nature of General | ||||||
| 2 | Assistance for basic maintenance requirements shall be | ||||||
| 3 | determined in accordance with local budget standards for local | ||||||
| 4 | governmental units which do not receive State funds. For local | ||||||
| 5 | governmental units which do receive State funds, the amount | ||||||
| 6 | and nature of General Assistance for basic maintenance | ||||||
| 7 | requirements shall be determined in accordance with the | ||||||
| 8 | standards, rules and regulations of the Illinois Department. | ||||||
| 9 | However, the amount and nature of any financial aid is not | ||||||
| 10 | affected by the payment of any grant under the Senior Citizens | ||||||
| 11 | and Persons with Disabilities Property Tax Relief Act, any | ||||||
| 12 | rebate authorized under Section 2201(a) of the Coronavirus | ||||||
| 13 | Aid, Relief, and Economic Security Act (Public Law 116-136) or | ||||||
| 14 | under any other federal economic stimulus program created in | ||||||
| 15 | response to the COVID-19 emergency, or any distributions or | ||||||
| 16 | items of income described under subparagraph (X) of paragraph | ||||||
| 17 | (2) of subsection (a) of Section 203 of the Illinois Income Tax | ||||||
| 18 | Act. Due regard shall be given to the requirements and the | ||||||
| 19 | conditions existing in each case, and to the income, money | ||||||
| 20 | contributions and other support and resources available, from | ||||||
| 21 | whatever source. In local governmental units which do not | ||||||
| 22 | receive State funds, the grant shall be sufficient when added | ||||||
| 23 | to all other income, money contributions and support in excess | ||||||
| 24 | of any excluded income or resources, to provide the person | ||||||
| 25 | with a grant in the amount established for such a person by the | ||||||
| 26 | local governmental unit based upon standards meeting basic | ||||||
| |||||||
| |||||||
| 1 | maintenance requirements. In local governmental units which do | ||||||
| 2 | receive State funds, the grant shall be sufficient when added | ||||||
| 3 | to all other income, money contributions and support in excess | ||||||
| 4 | of any excluded income or resources, to provide the person | ||||||
| 5 | with a grant in the amount established for such a person by | ||||||
| 6 | Department regulation based upon standards providing a | ||||||
| 7 | livelihood compatible with health and well-being, as directed | ||||||
| 8 | by Section 12-4.11 of this Code. | ||||||
| 9 | The Illinois Department may conduct special projects, | ||||||
| 10 | which may be known as Grant Diversion Projects, under which | ||||||
| 11 | recipients of financial aid under this Article are placed in | ||||||
| 12 | jobs and their grants are diverted to the employer who in turn | ||||||
| 13 | makes payments to the recipients in the form of salary or other | ||||||
| 14 | employment benefits. The Illinois Department shall by rule | ||||||
| 15 | specify the terms and conditions of such Grant Diversion | ||||||
| 16 | Projects. Such projects shall take into consideration and be | ||||||
| 17 | coordinated with the programs administered under the Illinois | ||||||
| 18 | Emergency Employment Development Act. | ||||||
| 19 | The allowances provided under Article IX for recipients | ||||||
| 20 | participating in the training and rehabilitation programs | ||||||
| 21 | shall be in addition to such maximum payment. | ||||||
| 22 | Payments may also be made to provide persons receiving | ||||||
| 23 | basic maintenance support with necessary treatment, care and | ||||||
| 24 | supplies required because of illness or disability or with | ||||||
| 25 | acute medical treatment, care, and supplies. Payments for | ||||||
| 26 | necessary or acute medical care under this paragraph may be | ||||||
| |||||||
| |||||||
| 1 | made to or in behalf of the person. Obligations incurred for | ||||||
| 2 | such services but not paid for at the time of a recipient's | ||||||
| 3 | death may be paid, subject to the rules and regulations of the | ||||||
| 4 | Illinois Department, after the death of the recipient. | ||||||

| 6 | Section 30. The Good Samaritan Energy Plan Act is amended | ||||||
| 7 | by changing Section 30 and by adding Section 95 as follows: | ||||||
| 8 | (305 ILCS 22/30) | ||||||
| 9 | Sec. 30. Distribution of moneys from Fund. Subject to | ||||||
| 10 | appropriations made by the General Assembly, the Department | ||||||
| 11 | may spend moneys from the Good Samaritan Energy Trust Fund for | ||||||
| 12 | the purpose of providing assistance authorized under Section | ||||||
| 13 | 25. The Department, with the advice and consent of the Low | ||||||
| 14 | Income Energy Assistance Policy Advisory Council, shall | ||||||
| 15 | establish priorities for the distribution of moneys from the | ||||||
| 16 | Good Samaritan Energy Trust Fund to low-income consumers to | ||||||
| 17 | enable them to pay gas or electric bill arrearages in order to | ||||||
| 18 | have household gas or electric utility service connected. | ||||||
| 19 | Low-income consumers who are unable to have their service | ||||||
| 20 | connected even with a LIHEAP grant shall be given preference. | ||||||
| 21 | Notwithstanding any other provision of law, on October 1, | ||||||
| 22 | 2025, or as soon thereafter as practical, the State | ||||||
| 23 | Comptroller shall direct and the State Treasurer shall | ||||||
| 24 | transfer the remaining balance from the Good Samaritan Energy | ||||||
| |||||||
| |||||||
| 1 | Trust Fund into the Supplemental Low-Income Energy Assistance | ||||||
| 2 | Fund. Upon completion of the transfer, the Good Samaritan | ||||||
| 3 | Energy Trust Fund is dissolved, any future deposits due to the | ||||||
| 4 | Good Samaritan Energy Trust Fund pass to the Supplemental | ||||||
| 5 | Low-Income Energy Assistance Fund, and any outstanding | ||||||
| 6 | obligations or liabilities of the Good Samaritan Energy Trust | ||||||
| 7 | Fund pass to the Supplemental Low-Income Energy Assistance | ||||||
| 8 | Fund. The Department shall ensure that moneys donated for the | ||||||
| 9 | Fund (other than moneys used for administrative expenses as | ||||||
| 10 | authorized in Section 25) are distributed to low-income | ||||||
| 11 | consumers who reside in the county from which those moneys | ||||||
| 12 | were received. | ||||||

| 16 | Section 35. The Urban Community Conservation Act is | ||||||
| 17 | amended by changing Section 4 as follows: | ||||||
| 18 | (315 ILCS 25/4) (from Ch. 67 1/2, par. 91.11) | ||||||
| 19 | Sec. 4. Excepting any municipality for and in which there | ||||||
| 20 | exists a Department of Urban Renewal created pursuant to the | ||||||
| 21 | provisions of the "Urban Renewal Consolidation Act of 1961", | ||||||
| 22 | enacted by the Seventy-Second General Assembly, any | ||||||
| 23 | municipality, after 30 days' notice, published in a newspaper | ||||||
| |||||||
| |||||||
| 1 | of general circulation within the municipality, and public | ||||||
| 2 | hearing, shall have the power to provide for the creation of a | ||||||
| 3 | Conservation Board, to operate within the boundaries of such | ||||||
| 4 | municipality, pursuant to the provisions of this Act. The | ||||||
| 5 | presiding officer of any municipality in which a Conservation | ||||||
| 6 | Board is established shall appoint, with the approval of the | ||||||
| 7 | governing body and of the Department of Commerce and Economic | ||||||
| 8 | Opportunity, five residents of the municipality to act as a | ||||||
| 9 | Conservation Board, hereinafter referred to as "the Board." | ||||||
| 10 | Members of the Board shall be citizens of broad civic | ||||||
| 11 | interest, administrative experience and ability in the fields | ||||||
| 12 | of finance, real estate, building, or related endeavors, not | ||||||
| 13 | more than three of whom shall belong to the same political | ||||||
| 14 | party. One such member shall be designated by the presiding | ||||||
| 15 | officer as Commissioner and shall serve at the pleasure of the | ||||||
| 16 | presiding officer. He shall administer the functions assigned | ||||||
| 17 | by the Board, preside over its meetings, and carry out | ||||||
| 18 | whatever other functions may be assigned to him by the | ||||||
| 19 | governing body. The Commissioner shall devote his full-time | ||||||
| 20 | attention to the duties of his office and shall receive no | ||||||
| 21 | public funds by way of salary, compensation, or remuneration | ||||||
| 22 | for services rendered, from any other governmental agency or | ||||||
| 23 | public body during his tenure in office, other than the salary | ||||||
| 24 | provided by the governing body, except as herein otherwise | ||||||
| 25 | specifically provided. | ||||||
| 26 | Four other members of the Board shall be appointed, to | ||||||
| |||||||
| |||||||
| 1 | serve one, two, three and four year terms. After the | ||||||
| 2 | expiration of the initial term of office each subsequent term | ||||||
| 3 | shall be of four years' duration. A member shall hold office | ||||||
| 4 | until his successor shall have been appointed and qualified. | ||||||
| 5 | Members of the Board shall be eligible to succeed themselves. | ||||||
| 6 | Members of the Board other than the Commissioner shall serve | ||||||
| 7 | without pay, except as herein otherwise specifically provided | ||||||
| 8 | and no member of the Board shall acquire any interest, direct | ||||||
| 9 | or indirect, in any conservation project, or in any property | ||||||
| 10 | included or planned to be included in any conservation | ||||||
| 11 | project, nor shall any member have any interest in any | ||||||
| 12 | contract or proposed contract in connection with any such | ||||||
| 13 | project. Members may be dismissed by the Presiding Office of | ||||||
| 14 | the Municipality for good cause shown. Such dismissal may be | ||||||
| 15 | set aside by a two-thirds vote of the governing body. | ||||||
| 16 | Notwithstanding anything to the contrary herein contained, the | ||||||
| 17 | Commissioner, may, during all or any part of his term also | ||||||
| 18 | serve as Chairman or member of a Redevelopment Commission | ||||||
| 19 | created pursuant to "The Neighborhood Redevelopment | ||||||
| 20 | Corporation Law" approved July 9, 1941, as amended, and shall | ||||||
| 21 | be entitled to receive and retain any salary payable to him as | ||||||
| 22 | Chairman or member of any such Redevelopment Commission. Three | ||||||
| 23 | members of the Conservation Board shall constitute a quorum to | ||||||
| 24 | transact business and no vacancy shall impair the right of the | ||||||
| 25 | remaining members to exercise all the powers of the Board; and | ||||||
| 26 | every act, order, rule, regulation or resolution of the | ||||||
| |||||||
| |||||||
| 1 | Conservation Board approved by a majority of the members | ||||||
| 2 | thereof at a regular or special meeting shall be deemed to be | ||||||
| 3 | the act, order, rule, regulation or resolution of the | ||||||
| 4 | Conservation Board. | ||||||
| 5 | The Conservation Board shall designate Conservation Areas | ||||||
| 6 | and | ||||||
| 7 | (a) Approve all conservation plans developed for | ||||||
| 8 | Conservation Areas in the manner prescribed herein; | ||||||
| 9 | (b) Approve each use of eminent domain for the acquisition | ||||||
| 10 | of real property for the purposes of this Act, provided that | ||||||
| 11 | every property owner affected by condemnation proceedings | ||||||
| 12 | shall have the opportunity to be heard by the Board before such | ||||||
| 13 | proceedings may be approved; | ||||||
| 14 | (c) Act as the agent of the Municipality in the | ||||||
| 15 | acquisition, management, and disposition of property acquired | ||||||
| 16 | pursuant to this Act as hereinafter provided; | ||||||
| 17 | (d) Act as agent of the governing body, at the discretion | ||||||
| 18 | of the governing body, in the enforcement and the | ||||||
| 19 | administration of any ordinances relating to the conservation | ||||||
| 20 | of urban residential areas and the prevention of slums enacted | ||||||
| 21 | by the governing body pursuant to the laws of this State; | ||||||
| 22 | (e) Report annually to the presiding officer of the | ||||||
| 23 | municipality; | ||||||
| 24 | (f) Shall, as agent for the Municipality upon approval by | ||||||
| 25 | the governing body, have power to apply for and accept capital | ||||||
| 26 | grants and loans from, and contract with, the United States of | ||||||
| |||||||
| |||||||
| 1 | America, the Housing and Home Finance Agency, or any other | ||||||
| 2 | Agency or instrumentality of the United States of America, for | ||||||
| 3 | or in aid of any of the purposes of this Act, and to secure | ||||||
| 4 | such loans by the issuance of debentures, notes, special | ||||||
| 5 | certificates, or other evidences of indebtedness, to the | ||||||
| 6 | United States of America; and | ||||||
| 7 | (g) Exercise any and all other powers as shall be | ||||||
| 8 | necessary to effectuate the purposes of this Act. | ||||||
