SYNOPSIS AS INTRODUCED:
 
220 ILCS 5/8-512 new

    Amends the Service Obligations and Conditions Article of the Public Utilities Act. Requires a natural gas public utility serving more than 35,000 customers to submit with its annual filing certain information concerning existing and newly installed pipeline facilities to the Illinois Commerce Commission. Requires the Commission to submit a report containing the information and evaluating the safety and reliability of the natural gas distribution system in Illinois to the General Assembly. Requires the reports to be made available to the public on the Commission's website.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Utilities Act is amended by adding
5Section 8-512 as follows:
 
6    (220 ILCS 5/8-512 new)
7    Sec. 8-512. Natural gas facility reporting.
8    (a) The General Assembly finds that the safety and
9reliability of the natural gas distribution system in Illinois
10is important to the health and welfare of the citizenry of this
11State. National and local events have demonstrated the
12importance of regular maintenance and replacement of gas
13pipeline and related facilities. In order to preserve the
14health and welfare of citizens and avoid the burden of large
15financial expenditures to remedy delayed pipeline replacement,
16the General Assembly finds that each natural gas utility
17subject to this Section shall be required to annually report to
18the Commission its existing and newly installed pipeline
19facilities in order to allow the Commission to monitor and
20address as necessary natural gas utilities' pipeline
21replacement programs.
22    (b) Each natural gas public utility serving more than
2335,000 customers shall submit to the Commission with its annual

1Form 21 ILCC filing the following additional information for a
2pipeline owned and operated by the utility as of December 31 of
3the preceding calendar year:
4        (1) the length in feet categorized by year of
5    installation;
6        (2) the length in feet categorized by diameter size and
7    material composed of;
8        (3) the length in feet categorized by scheduled
9    replacement year, if any;
10        (4) the length in feet installed during the preceding
11    calendar year for the purpose of replacing existing
12    pipeline and under a tariff authorized by Section 9-220.3
13    categorized by diameter size and material composed of;
14        (5) the length in feet installed during the preceding
15    calendar year for the purpose of replacing existing
16    pipeline and not under a tariff authorized by Section
17    9-220.3 categorized by diameter size and material composed
18    of;
19        (6) the length in feet installed during the preceding
20    calendar year not for the purpose of replacing existing
21    pipeline categorized by diameter size and material
22    composed of;
23        (7) the cost incurred and associated number of meters,
24    by individual project, for the construction activities
25    described in paragraphs (4), (5), and (6); and
26        (8) for the construction activities described in

1    paragraphs (4), (5), and (6), a brief description of the
2    reason for the activities.
3    (c) No later than October 1 of each year, the Commission
4shall submit to the General Assembly a report containing the
5information set forth in subsection (b) and evaluating the
6safety and reliability of the natural gas distribution system
7in Illinois. The Commission report shall address the
8sufficiency of utility plans for replacing obsolete pipeline
9and maintaining the safety and reliability of their respective
10gas distribution systems.
11    (d) The annual reports submitted to the Commission by the
12natural gas utilities and the report submitted by the
13Commission to the General Assembly shall be made available to
14the public on the Commission's website. The first reports of
15the additional information required under subsection (b) shall
16be for 2018 and submitted to the Commission in 2019.
17    (e) If the Commission deems it necessary, it may adopt
18rules to facilitate implementation of the reporting
19requirements contained in this Section. The Commission may
20require additional information from the gas utilities subject
21to this Section if necessary to provide the report to the
22General Assembly required under subsection (c).
