    Amends the State Finance Act. Creates the Peace Officers Memorial Foundation of Cook County Fund as a special fund in the State treasury. Amends the Illinois Vehicle Code to allow for the issuance of decals for Universal special license plates by the Peace Officers Memorial Foundation of Cook County. Provides for the original fee, renewal fees, and fee distribution for Universal special license plates with decals issued by the Peace Officers Memorial Foundation of Cook County.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Section 5.891 as follows:
 
6    (30 ILCS 105/5.891 new)
7    Sec. 5.891. The Peace Officers Memorial Foundation of Cook
8County Fund.
 
9    Section 10. The Illinois Vehicle Code is amended by
10changing Section 3-699.14 as follows:
 
11    (625 ILCS 5/3-699.14)
12    Sec. 3-699.14. Universal special license plates.
13    (a) In addition to any other special license plate, the
14Secretary, upon receipt of all applicable fees and applications
15made in the form prescribed by the Secretary, may issue
16Universal special license plates to residents of Illinois on
17behalf of organizations that have been authorized by the
18General Assembly to issue decals for Universal special license
19plates. Appropriate documentation, as determined by the
20Secretary, shall accompany each application. Authorized
21organizations shall be designated by amendment to this Section.

1When applying for a Universal special license plate the
2applicant shall inform the Secretary of the name of the
3authorized organization from which the applicant will obtain a
4decal to place on the plate. The Secretary shall make a record
5of that organization and that organization shall remain
6affiliated with that plate until the plate is surrendered,
7revoked, or otherwise cancelled. The authorized organization
8may charge a fee to offset the cost of producing and
9distributing the decal, but that fee shall be retained by the
10authorized organization and shall be separate and distinct from
11any registration fees charged by the Secretary. No decal,
12sticker, or other material may be affixed to a Universal
13special license plate other than a decal authorized by the
14General Assembly in this Section or a registration renewal
15sticker. The special plates issued under this Section shall be
16affixed only to passenger vehicles of the first division,
17including motorcycles and autocycles, or motor vehicles of the
18second division weighing not more than 8,000 pounds. Plates
19issued under this Section shall expire according to the
20multi-year procedure under Section 3-414.1 of this Code.
21    (b) The design, color, and format of the Universal special
22license plate shall be wholly within the discretion of the
23Secretary. Universal special license plates are not required to
24designate "Land of Lincoln", as prescribed in subsection (b) of
25Section 3-412 of this Code. The design shall allow for the
26application of a decal to the plate. Organizations authorized

1by the General Assembly to issue decals for Universal special
2license plates shall comply with rules adopted by the Secretary
3governing the requirements for and approval of Universal
4special license plate decals. The Secretary may, in his or her
5discretion, allow Universal special license plates to be issued
6as vanity or personalized plates in accordance with Section
73-405.1 of this Code. The Secretary of State must make a
8version of the special registration plates authorized under
9this Section in a form appropriate for motorcycles and
10autocycles.
11    (c) When authorizing a Universal special license plate, the
12General Assembly shall set forth whether an additional fee is
13to be charged for the plate and, if a fee is to be charged, the
14amount of the fee and how the fee is to be distributed. When
15necessary, the authorizing language shall create a special fund
16in the State treasury into which fees may be deposited for an
17authorized Universal special license plate. Additional fees
18may only be charged if the fee is to be paid over to a State
19agency or to a charitable entity that is in compliance with the
20registration and reporting requirements of the Charitable
21Trust Act and the Solicitation for Charity Act. Any charitable
22entity receiving fees for the sale of Universal special license
23plates shall annually provide the Secretary of State a letter
24of compliance issued by the Attorney General verifying that the
25entity is in compliance with the Charitable Trust Act and the
26Solicitation for Charity Act.

1    (d) Upon original issuance and for each registration
2renewal period, in addition to the appropriate registration
3fee, if applicable, the Secretary shall collect any additional
4fees, if required, for issuance of Universal special license
5plates. The fees shall be collected on behalf of the
6organization designated by the applicant when applying for the
7plate. All fees collected shall be transferred to the State
8agency on whose behalf the fees were collected, or paid into
9the special fund designated in the law authorizing the
10organization to issue decals for Universal special license
11plates. All money in the designated fund shall be distributed
12by the Secretary subject to appropriation by the General
13Assembly.
14    (e) The following organizations may issue decals for
15Universal special license plates with the original and renewal
16fees and fee distribution as follows:
17        (1) The Illinois Department of Natural Resources.
18            (A) Original issuance: $25; with $10 to the
19        Roadside Monarch Habitat Fund and $15 to the Secretary
20        of State Special License Plate Fund.
21            (B) Renewal: $25; with $23 to the Roadside Monarch
22        Habitat Fund and $2 to the Secretary of State Special
23        License Plate Fund.
24        (2) Illinois Veterans' Homes.
25            (A) Original issuance: $26, which shall be
26        deposited into the Illinois Veterans' Homes Fund.

1            (B) Renewal: $26, which shall be deposited into the
2        Illinois Veterans' Homes Fund.
3        (3) The Illinois Department of Human Services for
4    volunteerism decals.
5            (A) Original issuance: $25, which shall be
6        deposited into the Secretary of State Special License
7        Plate Fund.
8            (B) Renewal: $25, which shall be deposited into the
9        Secretary of State Special License Plate Fund.
10        (4) The Illinois Department of Public Health.
11            (A) Original issuance: $25; with $10 to the
12        Prostate Cancer Awareness Fund and $15 to the Secretary
13        of State Special License Plate Fund.
14            (B) Renewal: $25; with $23 to the Prostate Cancer
15        Awareness Fund and $2 to the Secretary of State Special
16        License Plate Fund.
17        (5) Horsemen's Council of Illinois.
18        (6) The Peace Officers Memorial Foundation of Cook
19    County.
20            (A) Original issuance: $25; with $10 to the Peace
21        Officers Memorial Foundation of Cook County Fund and
22        $15 to the Secretary of State Special License Plate
23        Fund.
24            (B) Renewal: $25; with $23 to the Peace Officers
25        Memorial Foundation of Cook County Fund and $2 to the
26        Secretary of State Special License Plate Fund.

1            (A) Original issuance: $25; with $10 to the
2        Horsemen's Council of Illinois Fund and $15 to the
3        Secretary of State Special License Plate Fund.
4            (B) Renewal: $25; with $23 to the Horsemen's
5        Council of Illinois Fund and $2 to the Secretary of
6        State Special License Plate Fund.
7    (f) The following funds are created as special funds in the
8State treasury:
9        (1) The Roadside Monarch Habitat Fund. All moneys to be
10    paid as grants to the Illinois Department of Natural
11    Resources to fund roadside monarch and other pollinator
12    habitat development, enhancement, and restoration projects
13    in this State.
14        (2) The Prostate Cancer Awareness Fund. All moneys to
15    be paid as grants to the Prostate Cancer Foundation of
16    Chicago.
17        (3) The Horsemen's Council of Illinois Fund. All moneys
18    shall be paid as grants to the Horsemen's Council of
19    Illinois.
20        (4) The Peace Officers Memorial Foundation of Cook
21    County Fund. All money in the Peace Officers Memorial
22    Foundation of Cook County Fund shall be paid as grants to
23    the Peace Officers Memorial Foundation of Cook County for
24    construction or maintenance of a memorial and park, holding
25    an annual memorial commemoration, giving scholarships to
26    children of Cook County peace officers killed or

1    catastrophically injured in the line of duty, providing
2    financial assistance to Cook County peace officers and
3    their families when a Cook County peace officer is killed
4    or injured in the line of duty, and paying the insurance
5    premiums for Cook County peace officers who are terminally
6    ill.
