SYNOPSIS AS INTRODUCED:

105 ILCS 5/10-16.8 new

    Amends the School Code. Provides that, beginning with the 2020-2021 school year, for an elementary school district that is designated by the State Board of Education as having a teacher shortage, each district superintendent shall receive for his or her services an annual salary of $175,000. Provides that an elementary school district may, by referendum approval of the school district's voters, provide a district superintendent a salary of more than $175,000 per year. Provides that if the referendum fails, the school district may not propose another referendum for at least 2 years after the date of the failed referendum.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
510-16.7 and by adding Section 10-16.8 as follows:
 
6    (105 ILCS 5/10-16.7)
7    Sec. 10-16.7. School board duties with respect to
8superintendent. In addition to all other powers and duties
9enumerated in this Article, the school board shall make all
10employment decisions pertaining to the superintendent, subject
11to any salary limitation under Section 10-16.8. The school
12board shall direct, through policy, the superintendent in his
13or her charge of the administration of the school district,
14including without limitation considering the recommendations
15of the superintendent concerning the budget, building plans,
16the locations of sites, the selection, retention, and dismissal
17of employees, and the selection of textbooks, instructional
18material, and courses of study. The school board shall evaluate
19the superintendent in his or her administration of school board
20policies and his or her stewardship of the assets of the
21district.

2    Sec. 10-16.8. District superintendent; salary.
3    (a) This Section applies only to an elementary school
4district that is designated by the State Board of Education as
5having a teacher shortage and, in such a case, only to an
6employment contract entered into, modified, or renewed on or
7after the effective date of this amendatory Act of the 101st
8General Assembly.
9    (b) Beginning with the 2020-2021 school year, a district
10superintendent shall receive for his or her services an annual
11salary of $175,000. An elementary school district may, by
12referendum approval of the school district's voters, provide a
13district superintendent a salary of more than $175,000 per
14year. The question of authorizing the school board to provide
15the district superintendent a salary of more than $175,000 a
16year must be submitted to the electors of the school district
17at a regular election and approved by a majority of the
18electors voting on the question. The school board must certify
19the question to the proper election authority, which must
20submit the question at an election in accordance with the
21Election Code. The election authority must submit the question
22in substantially the following form:
23        Shall the school board of (name of school district) be
24    authorized to provide the district superintendent a salary
25    of more than $175,000 per year?
26The election authority must record the votes as "Yes" or "No".

1If a majority of the electors voting on the question vote in
2the affirmative, the school district may thereafter provide the
3district superintendent a salary of more than $175,000 per
4year. If the referendum fails, the school district may not
5propose another referendum under this Section for at least 2
6years after the date of the failed referendum.
