SYNOPSIS AS INTRODUCED:
 
725 ILCS 5/Art. 124C heading new
725 ILCS 5/124C-5 new

    Amends the Code of Criminal Procedure of 1963. Provides that a firearm may not be seized by the court unless: (1) the person is subject to revocation and seizure under the Firearm Owners Identification Card Act; (2) the person subject to a firearms restraining order under the Firearms Restraining Order Act; (3) the firearm is required for evidentiary purposes; or (4) the firearm is subject to seizure as otherwise authorized by State or federal law.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Code of Criminal Procedure of 1963 is
5amended by adding Article 124C as follows:

ARTICLE 124C. FIREARM SEIZURE

 
8    (725 ILCS 5/124C-5 new)
9    Sec. 124C-5. Firearm seizure. A firearm may not be seized
10by the court unless:
11    (1) the person is subject to revocation and seizure under
12Section 8 of the Firearm Owners Identification Card Act;
13    (2) the person subject to a firearms restraining order
14under the Firearms Restraining Order Act;
15    (3) the firearm is required for evidentiary purposes; or
16    (4) the firearm is subject to seizure as otherwise
17authorized by State or federal law.
