SYNOPSIS AS INTRODUCED:

725 ILCS 5/Art. 124C heading new
725 ILCS 5/124C-5 new

Amends the Code of Criminal Procedure of 1963. Provides that a firearm may not be seized by the court unless: (1) the person is subject to revocation and seizure under the Firearm Owners Identification Card Act; (2) the person subject to a firearms restraining order under the Firearms Restraining Order Act; (3) the firearm is required for evidentiary purposes; or (4) the firearm is subject to seizure as otherwise authorized by State or federal law.

AN ACT concerning criminal law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Code of Criminal Procedure of 1963 is amended by adding Article 124C as follows:

ARTICLE 124C. FIREARM SEIZURE

(725 ILCS 5/124C-5 new)

Sec. 124C-5. Firearm seizure. A firearm may not be seized by the court unless:

(1) the person is subject to revocation and seizure under Section 8 of the Firearm Owners Identification Card Act;

(2) the person subject to a firearms restraining order under the Firearms Restraining Order Act;

(3) the firearm is required for evidentiary purposes; or

(4) the firearm is subject to seizure as otherwise authorized by State or federal law.
