1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Solid Waste Planning and Recycling Act is
5amended by adding Section 4.5 as follows:
 
6    (415 ILCS 15/4.5 new)
7    Sec. 4.5. Statewide Materials Management Advisory
8Committee; Report.
9    (a) The Statewide Materials Management Advisory Committee
10is hereby created.
11    (b) The Advisory Committee shall:
12        (1) investigate and provide recommendations for
13    expanding waste reduction, recycling, reuse, and
14    composting in Illinois in a manner that protects the
15    environment, as well as public health and safety, and
16    promotes economic development;
17        (2) investigate and provide recommendations for the
18    form and contents of county waste management plans adopted
19    under this Act; and
20        (3) prepare a report as required under Section 4.6 of
21    this Act.
22    (c) The Advisory Committee shall be composed of the
23following:

1        (1) The Director of the Agency, or his or her designee,
2    who shall serve as an ex officio and nonvoting member.
3        (2) 25 voting members appointed by the Director of the
4    Agency, as follows:
5            (A) one member representing a municipality with a
6        population of more than 1,000,000;
7            (B) one member representing a county with a
8        population of more than 1,000,000;
9            (C) two members representing counties with a
10        population of at least 200,000 but not more than
11        1,000,000;
12            (D) two members representing counties with a
13        population of at least 85,000 but not more than
14        200,000;
15            (E) two members representing counties with a
16        population of less than 85,000;
17            (F) two members representing the solid waste
18        management industry;
19            (G) two members representing the recycling
20        industry;
21            (H) two members representing providers of general
22        construction and demolition debris recycling services;
23            (I) two members representing environmental
24        interest groups;
25            (J) two members representing manufacturers in the
26        State;

1            (K) two members representing retailers in the
2        State;
3            (L) two members representing producers of compost;
4        and
5            (M) three members representing producers of end
6        products generated through recycling.
7    (d) The Director of the Agency shall appoint all members of
8the Advisory Committee by no later than January 1, 2020.
9    (e) The initial meeting of the Advisory Committee shall be
10convened by the Director of the Agency, or his or her designee,
11no later than March 1, 2020. At the initial meeting, the voting
12members shall select co-chairs. Subsequent meetings shall
13convene at the call of the co-chairs.
14    (f) A simple majority of those appointed shall constitute a
15quorum. The affirmative vote of a majority of those present and
16voting shall be necessary for Advisory Committee action.
17    (g) Members of the Advisory Committee shall receive no
18compensation for their services.
19    (h) The Agency shall provide administrative assistance and
20technical support to the Advisory Committee. The Agency may
21obtain assistance from outside experts to assist in preparation
22of the Plan. Funding for the Plan and assistance from outside
23experts shall be obtained from the Solid Waste Management Fund.
24    (i) On or before July 1, 2021, the Advisory Committee shall
25prepare and submit a report to the General Assembly summarizing
26its work.

1    (j) The report shall include, at a minimum, the following
2information:
3        (1) an estimate of the amount and composition of waste
4    generated annually in Illinois with 2018 as the base year;
5        (2) an estimate of the amount of waste disposed of
6    annually in Illinois with 2018 as the base year;
7        (3) an estimate of the amount of material diverted from
8    landfills annually in Illinois with 2018 as the base year;
9        (4) an analysis of the markets available for materials
10    diverted from Illinois landfills;
11        (5) recommended materials in the municipal waste
12    stream that could be targeted to maximize waste diversion;
13        (6) recommended actions that could be taken to increase
14    landfill diversion rates and the costs associated with
15    those actions;
16        (7) recommended education and public outreach programs
17    that could maximize waste diversion;
18        (8) recommended diversion rates that are achievable by
19    2025, 2030, and 2035; and
20        (9) a database and map of permitted facilities,
21    including, but not limited to, landfills, garbage transfer
22    stations, landscape waste transfer stations, construction
23    and demolition debris recycling facilities, recycling
24    facilities, compost sites, and scrap metal recycling
25    facilities.
26    (k) In addition, the report shall also include, at a

1minimum, the following recommendations for waste management
2plans required under this Act:
3        (1) recommended elements for counties to include in
4    waste management plans required under this Act;
5        (2) a recommended standard methodology for counties to
6    use to determine the annual waste generation rate in the
7    county;
8        (3) a recommended standard methodology for counties to
9    use to determine the annual disposal rate in the county;
10        (4) a recommended standard methodology for counties to
11    use to determine the annual diversion rate in the county;
12        (5) recommended standard actions that can be taken by
13    counties to increase landfill diversion rates;
14        (6) recommended education and public outreach programs
15    that could maximize waste diversion within the county; and
16        (7) recommended standard content for waste management
17    plans required under this Act.
18    (l) The report may include a list of nonpermitted
19facilities that are involved in waste disposal, materials
20recycling, or composting.
21    (m) This Section is repealed on July 1, 2022.
 
22    Section 99. Effective date. This Act takes effect upon
23becoming law.
