SYNOPSIS AS INTRODUCED:
 
225 ILCS 115/19.3 new

    Amends the Veterinary Medicine and Surgery Practice Act of 2004. Provides that a veterinarian licensed under the Act shall limit the initial amount dispensed of a Schedule II controlled substance under the Illinois Controlled Substances Act to a 5-day supply at a dosage clinically appropriate for the animal being treated. Provides that a prescription that is filled at a pharmacy is not subject to this limit. Provides that a veterinarian licensed under the Act shall limit the initial amount dispensed of a benzodiazepine to a 14-day supply at a dosage clinically appropriate for the animal being treated. Provides that a prescription that is filled at a pharmacy is not subject to this limit. Provides that for the treatment of an animal with a chronic condition that requires the long-term use of a Schedule II controlled substance or a benzodiazepine, after the initial 5-day or 14-day period, the licensed veterinarian may dispense not more that a 30-day supply at one time at a dosage clinically appropriate for the animal being treated. Provides that a prescription that is filled at a pharmacy is not subject to this limit.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Veterinary Medicine and Surgery Practice Act
5of 2004 is amended by adding Section 19.3 as follows:
 
6    (225 ILCS 115/19.3 new)
7    Sec. 19.3. Prescription requirements.
8    (a) A veterinarian licensed under this Act shall limit the
9initial amount dispensed of a Schedule II controlled substance
10under Section 206 of the Illinois Controlled Substances Act to
11a 5-day supply at a dosage clinically appropriate for the
12animal being treated. A prescription that is filled at a
13pharmacy is not subject to this limit.
14    (b) A veterinarian licensed under this Act shall limit the
15initial amount dispensed of a benzodiazepine to a 14-day supply
16at a dosage clinically appropriate for the animal being
17treated. A prescription that is filled at a pharmacy is not
18subject to this limit.
19    (c) For the treatment of an animal with a chronic condition
20that requires the long-term use of a Schedule II controlled
21substance or a benzodiazepine, after the initial 5-day or
2214-day period under subsection (a) or (b), the licensed
23veterinarian may dispense not more that a 30-day supply at one

1time at a dosage clinically appropriate for the animal being
2treated. A prescription that is filled at a pharmacy is not
3subject to this limit. In this subsection (c), "chronic
4condition" means a condition that requires on-going treatment
5beyond the 5-day or 14-day period prescribed in subsection (a)
6or (b) including cancer, post-surgical treatment,
7post-traumatic injury, neuropathic pain, chronic severe cough,
8collapsing trachea, and congestive heart failure.
