SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/14-17 new

    Amends the Children with Disabilities Article of the School Code. Requires a school district to provide notification to the parent or guardian of a student with an individualized education program (IEP) that the student may be eligible to receive additional specified services, benefits, or resources. Provides that the written notification must be provided no later than 30 days following the implementation of the initial IEP and once a year thereafter. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
514-17 as follows:
 
6    (105 ILCS 5/14-17 new)
7    Sec. 14-17. Parental notification of additional resources.
8    (a) In this Section:
9    "PUNS" means the Prioritization of Urgency of Need for
10Services database established under Section 10-26 of the
11Department of Human Services Act.
12    "Special-needs trust" means a special-needs trust as
13defined in Section 1213 of the Illinois Trust Code.
14    "SSI" means federal Supplemental Security Income.
15    (b) A school district must provide written notification to
16the parent or guardian of a student with an individualized
17education program (IEP) that the student may be eligible to
18receive additional services, benefits, or resources through
19PUNS or SSI or may benefit from a special-needs trust as a
20beneficiary.
21    (c) A school district must provide the written notification
22under subsection (b) no later than 30 days following the
23implementation of the initial IEP for the student and once a

1year thereafter.
2    (d) The State Board of Education shall adopt rules to
3implement this Section.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.
