SYNOPSIS AS INTRODUCED:
 
20 ILCS 405/405-317 new

    Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Provides that each State building constructed, acquired, or of which more than 50% of the façade is substantially altered shall meet specified standards concerning bird safety. Provides requirements for the Director of Central Management Services in implementing the standards. Specifies that the provisions shall not apply to any acquisition or substantial alteration if the Director, after consideration of multiple options, determines that the use of the required building materials and design features would result in a significant additional cost for the project. Exempts specified buildings from the requirements.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6adding Section 405-317 as follows:
 
7    (20 ILCS 405/405-317 new)
8    Sec. 405-317. Bird-safe State buildings.
9    (a) Each State building constructed, acquired, or of which
10more than 50% of the façade is substantially altered, in the
11opinion of the Department's Bureau of Property Management,
12shall meet, as determined by the Director, the following
13standards:
14        (1) at least 90% of the exposed façade material from
15    ground level to 40 feet: (A) shall not be composed of
16    glass; or (B) shall be composed of glass employing (i)
17    elements that preclude bird collisions without completely
18    obscuring vision, such as secondary facades, netting,
19    screens, shutters, and exterior shades; (ii) ultraviolet
20    (UV) patterned glass that contains UV-reflective or
21    contrasting patterns that are visible to birds; (iii)
22    patterns on glass designed in accordance with a rule that
23    restricts horizontal spaces to less than 2 inches high and

1    vertical spaces to less than 4 inches wide; (iv) opaque,
2    etched, stained, frosted, or translucent glass; or(v) any
3    combination of the methods described in this item (B);
4        (2) at least 60% of the exposed facade material above
5    40 feet shall meet the standard described in paragraph (1);
6        (3) there shall not be any transparent passageways or
7    corners;
8        (4) all glass adjacent to atria or courtyards
9    containing water features, plants, and other materials
10    attractive to birds shall meet the standard described in
11    item (B) of paragraph (1); and
12        (5) outside lighting shall be appropriately shielded
13    and minimized subject to security and other mission related
14    requirements.
15    (b) The Director shall take such actions as may be
16necessary to ensure that actual bird mortality is monitored at
17each State building.
18    (c) The Director, where practicable and consistent with
19security and other mission related requirements, shall reduce
20exterior building and site lighting for each State building.
21This subsection (c) shall not apply to buildings in which the
22Director does not have control of the exterior building and
23site lighting. In implementing the requirements of this
24subsection (c), the Director shall make use of automatic
25control technologies, including timers, photo-sensors, and
26infrared and motion detectors.

1    (d) In implementing the requirements of this Section, the
2Director may employ any available methods and strategies that
3are in accordance with existing effective best practices to
4reduce bird mortality.
5    (e) The requirements of this Section shall not apply to any
6acquisition or substantial alteration described in subsection
7(a) if the Director, after consideration of multiple options,
8determines that the use of the required building materials and
9design features would result in a significant additional cost
10for the project.
11    (f) This Section shall not apply to the following
12buildings:
13        (1) any building or site listed, or eligible for
14    listing, on the National Register of Historic Places;
15        (2) the Executive Mansion and its grounds;
16        (3) the Illinois Supreme Court Building and its
17    grounds;
18        (4) the Old State Capitol Building in Springfield,
19    Illinois, and its related buildings and grounds;
20        (5) the Lincoln Home in Springfield, Illinois, and its
21    related buildings and grounds;
22        (6) the Abraham Lincoln Presidential Library and
23    Museum and its related buildings and grounds; and
24        (7) the Illinois State Capitol Building and its related
25    buildings and grounds.
