SYNOPSIS AS INTRODUCED:

65 ILCS 5/11-15.3-15 new

    Amends the Wind Farm Division of the Illinois Municipal Code. Changes the name of the Division to the Alternative Energy and Storage Division. Allows a municipality to own and operate a photovoltaic generation farm, energy storage facility, or biomass-fired combined heat and power plant that directly or indirectly reduces the energy or other operating costs of the municipality. Allows a municipality to ask for the assistance of any State agency in obtaining financing options for such operations. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5changing the heading of Division 15.3 of Article 11 and by
6adding Sections 11-15.3-5, 11-15.3-10, and 11-15.3-15 as
7follows:

12    Sec. 11-15.3-5. Photovoltaic farms. A municipality may own
13and operate a photovoltaic generation farm, either
14individually or jointly with another unit of local government,
15school district, or community college district that is
16authorized to own and operate a photovoltaic generation farm,
17that directly or indirectly reduces the energy or other
18operating costs of the municipality. The municipality may ask
19for the assistance of any State agency, including, without
20limitation, the Department of Commerce and Economic
21Opportunity, the Illinois Power Agency, or the Environmental
22Protection Agency, in obtaining financing options for a

21directly or indirectly reduces the energy or other operating
22costs of the municipality. The municipality may ask for the
23assistance of any State agency, including, without limitation,
24the Department of Commerce and Economic Opportunity, the

4    Section 99. Effective date. This Act takes effect upon
5becoming law.
