HOUSE RESOLUTION

 
2    WHEREAS, The right to privacy is a fundamental right
3protected by the United States Constitution and the Illinois
4Constitution; and
 
5    WHEREAS, Article I, Section 12 of the Illinois Constitution
6provides for a remedy in the law for "all injuries and wrongs"
7to privacy; and
 
8    WHEREAS, The citizens of Illinois have been subjected to an
9ever-increasing amount of online surveillance from private
10companies that collect, share, and sell their data for profit
11without their knowledge or consent; and
 
12    WHEREAS, According to the Pew Research Center, the distrust
13of technology and technology companies has reached an all-time
14high, as over 80% of Americans believe they have very little to
15no control over their data, and that the potential risks of
16collecting data now outweigh the benefit of such collection;
17and
 
18    WHEREAS, In December of 2019, the National Institute of
19Standards and Technology issued a report finding concrete
20evidence of racial bias in the use of facial recognition
21technology, concluding that the majority of face recognition

1algorithms were significantly more likely to inaccurately
2identify a photograph of the face of an African-American or
3East Asian person, compared to the face of a white person; and
 
4    WHEREAS, Current law fails to provide adequate protections
5for children when it comes to the collection, sharing, and
6aggregation of all types of data; and
 
7    WHEREAS, Illinois has long been a leader in protecting the
8privacy of the citizens of Illinois through the passage of the
9Biometric Information Privacy Act, which prohibits companies
10from unlawfully collecting fingerprints and using facial
11recognition without consent; and
 
12    WHEREAS, Over the last decade, technological advancement
13has significantly outpaced current law, leading to significant
14gaps in Illinois law and a "wild west" environment when it
15comes to the protection of the vast majority of consumer data;
16therefore, be it
 
17    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
18HUNDRED FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
19we urge Illinois to continue to be a leader in the protection
20of the privacy of its citizens by codifying the Illinois
21Constitution's fundamental right of privacy, which includes:
22(i) the right to consent before private data is collected or

1shared, (ii) the right to know with whom data is shared and
2sold, (iii) the right to have a company delete data upon
3request, (iv) the right to opt-in to having data collected,
4shared, or sold, and (v) the right to data portability; and be
5it further
 
6    RESOLVED, That we declare January 28, 2020 as "Data Privacy
7Day" in the State of Illinois.
