AN ACT concerning education.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The School Code is amended by adding Sections 2-3.176, 10-20.69, and 34-18.61 as follows:

Sec. 2-3.176. Sexual assault data. The State Board of Education shall post on its website for each school year the total number of incidents reported under Sections 10-20.69 and 34-18.61 of this Code statewide and in each school district. The State Board shall also report the data annually to the General Assembly no later than September 1 of each year.

Sec. 10-20.69. Attacks on students; sexual assault.

(a) In this Section, "sexual assault" means any act of nonconsensual sexual conduct or sexual penetration, as defined under Section 11-0.1 of the Criminal Code of 2012, including, but not limited to, acts prohibited under Sections 11-1.20 through 11-1.60 of the Criminal Code of 2012.

(b) Upon knowledge of an incident of sexual assault by a student against another student, a school district shall report the incident to the State Board of Education.

Sec. 34-18.61. Attacks on students; sexual assault.

(a) In this Section, "sexual assault" means any act of nonconsensual sexual conduct or sexual penetration, as defined under Section 11-0.1 of the Criminal Code of 2012, including, but not limited to, acts prohibited under Sections 11-1.20 through 11-1.60 of the Criminal Code of 2012.

(b) Upon knowledge of an incident of sexual assault by a student against another student, the school district shall report the incident to the State Board of Education.
