1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title; references to Act.
5    (a) Short title. This Act may be cited as the Dense Breast
6Tissue Act.
7    (b) References to Act. This Act may be referred to as the
8Patti Beyer Act of Illinois.
 
9    Section 5. Applicability. This Act applies to a facility
10that provides mammography services in the State of Illinois.
 
11    Section 10. Breast cancer; duty of providers of mammography
12services to notify and inform.
13    (a) As used in this Section, "dense breast tissue" means
14heterogeneously dense or extremely dense tissue as defined in
15nationally recognized guidelines or systems for breast imaging
16reporting of mammography screening, including, but not limited
17to, the Breast Imaging Reporting and Data System of the
18American College of Radiology, and any equivalent new terms, as
19such guidelines or systems are updated.
20    (b) If a patient's mammogram demonstrates dense breast
21tissue, the provider of mammography services shall provide in a
22summary of the mammography report sent to the patient in

1accordance with the federal Mammography Quality Standards Act a
2notice substantially similar to the following:
3        "Your mammogram indicates you have dense breast
4    tissue. Dense breast tissue is normal and identified on
5    mammograms in about 50% of women. Dense breast tissue can
6    make it more difficult to detect cancer on a mammogram and
7    may be associated with an increased risk for breast cancer.
8    Despite these limitations, screening mammograms have been
9    proven to save lives. Continue to have routine screening
10    mammography whether or not additional exams are suggested
11    for you. This information is provided to raise your
12    awareness of the impact of breast density on cancer
13    detection. For further information about dense breast
14    tissue, as well as other breast cancer risk factors,
15    contact your breast imaging health care provider.".
16    (c) A facility that performs mammography may update the
17language in the notice under subsection (b) to reflect advances
18in science and technology as long as it continues to notify
19patients about dense breast tissue and its effect on the
20accuracy of mammograms and encourages patients to discuss the
21issue with their health care provider.
22    (d) This Section does not create a duty of care or other
23legal obligation beyond the duty to provide notice as set forth
24in this Section.

1    Section 90. The Department of Public Health Powers and
2Duties Law of the Civil Administrative Code of Illinois is
3amended by repealing Section 2310-697.
