SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/11E-132 new

    Amends the Conversion and Formation of School Districts Article of the School Code. Within 3 years after the effective date of the amendatory Act, requires elementary districts and high school districts to form new unit districts, subject to the requirement that elementary districts must form new unit districts but only with other elementary districts and high school districts must form new unit districts but only with other high school districts, notwithstanding any referendum requirements or any other laws to the contrary. Provides that a unit district is prohibited from consolidating with another unit district under these provisions. Provides that the State Board of Education shall facilitate the creation of the new unit districts by providing recommendations on which districts must consolidate. Sets forth the factors that the State Board must take into consideration. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
511E-132 as follows:
 
6    (105 ILCS 5/11E-132 new)
7    Sec. 11E-132. Elementary and high school district
8consolidation required. Within 3 years after the effective date
9of this amendatory Act of the 101st General Assembly,
10elementary districts shall form new unit districts but only
11with other elementary districts and high school districts shall
12form new unit districts but only with other high school
13districts, notwithstanding any referendum requirements or any
14other laws to the contrary. Subject to the requirement that no
15unit district may be consolidated with another unit district
16under this Section, the State Board of Education shall
17facilitate the creation of the new unit districts by providing
18recommendations on which districts must consolidate. The State
19Board shall take into consideration the location of the
20affected districts in relationship to each other, the school
21needs and conditions of the affected districts and in the area
22adjacent to those districts, the classification of funds and
23assets that will result from the consolidation, the best

1interests of the schools of the affected districts, and the
2best interests and the educational welfare of the pupils
3residing in the affected districts.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.
