SYNOPSIS AS INTRODUCED:

105 ILCS 5/11E-132 new

Amends the Conversion and Formation of School Districts Article of the School Code. Within 3 years after the effective date of the amendatory Act, requires elementary districts and high school districts to form new unit districts, subject to the requirement that elementary districts must form new unit districts but only with other elementary districts and high school districts must form new unit districts but only with other high school districts, notwithstanding any referendum requirements or any other laws to the contrary. Provides that a unit district is prohibited from consolidating with another unit district under these provisions. Provides that the State Board of Education shall facilitate the creation of the new unit districts by providing recommendations on which districts must consolidate. Sets forth the factors that the State Board must take into consideration. Effective immediately.

AN ACT concerning education.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The School Code is amended by adding Section 11E-132 as follows:

Sec. 11E-132. Elementary and high school district consolidation required. Within 3 years after the effective date of this amendatory Act of the 101st General Assembly, elementary districts shall form new unit districts but only with other elementary districts and high school districts shall form new unit districts but only with other high school districts, notwithstanding any referendum requirements or any other laws to the contrary. Subject to the requirement that no unit district may be consolidated with another unit district under this Section, the State Board of Education shall facilitate the creation of the new unit districts by providing recommendations on which districts must consolidate. The State Board shall take into consideration the location of the affected districts in relationship to each other, the school needs and conditions of the affected districts and in the area adjacent to those districts, the classification of funds and assets that will result from the consolidation, the best interests of the schools of the affected districts, and the best interests and the educational welfare of the pupils residing in the affected districts.

Section 99. Effective date. This Act takes effect upon becoming law.
