SYNOPSIS AS INTRODUCED:
 
405 ILCS 5/3-602  from Ch. 91 1/2, par. 3-602

    Amends the Mental Health and Developmental Disabilities Code. Provides that the examination by a physician, qualified examiner, psychiatrist, advanced practice psychiatric nurse, or clinical psychologist to determine whether the respondent is subject to involuntary admission on an inpatient basis may be performed via telehealth as defined in the Telehealth Act.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Mental Health and Developmental
5Disabilities Code is amended by changing Section 3-602 as
6follows:
 
7    (405 ILCS 5/3-602)  (from Ch. 91 1/2, par. 3-602)
8    Sec. 3-602. The petition shall be accompanied by a
9certificate executed by a physician, qualified examiner,
10psychiatrist, advanced practice psychiatric nurse, or clinical
11psychologist which states that the respondent is subject to
12involuntary admission on an inpatient basis and requires
13immediate hospitalization. The certificate shall indicate that
14the physician, qualified examiner, psychiatrist, advanced
15practice psychiatric nurse, or clinical psychologist
16personally examined the respondent not more than 72 hours prior
17to admission. The examination may be performed via telehealth
18as defined in Section 5 of the Telehealth Act. It shall also
19contain the physician's, qualified examiner's, psychiatrist's,
20advanced practice psychiatric nurse's, or clinical
21psychologist's clinical observations, other factual
22information relied upon in reaching a diagnosis, and a
23statement as to whether the respondent was advised of his
