1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    (20 ILCS 5/5-530 rep.)
5    Section 5. The Civil Administrative Code of Illinois is
6amended by repealing Section 5-530.
 
7    Section 10. The Department of Agriculture Law of the Civil
8Administrative Code of Illinois is amended by changing Section
9205-40 as follows:
 
10    (20 ILCS 205/205-40)  (was 20 ILCS 205/40.31)
11    Sec. 205-40. Export consulting service and standards. The
12Department, in cooperation with the Department of Commerce and
13Economic Opportunity and the Agricultural Export Advisory
14Committee, shall (1) provide a consulting service to those who
15desire to export farm products, commodities, and supplies and
16guide them in their efforts to improve trade relations; (2)
17cooperate with agencies and instrumentalities of the federal
18government to develop export grade standards for farm products,
19commodities, and supplies produced in Illinois and adopt
20reasonable rules and regulations to ensure that exports of
21those products, commodities, and supplies comply with those
22standards; (3) upon request and after inspection of any such

1farm product, commodity, or supplies, certify compliance or
2noncompliance with those standards; (4) provide an
3informational program to existing and potential foreign
4importers of farm products, commodities, and supplies; (5)
5qualify for U. S. Department of Agriculture matching funds for
6overseas promotion of farm products, commodities, and supplies
7according to the federal requirements regarding State
8expenditures that are eligible for matching funds; and (6)
9provide a consulting service to persons who desire to export
10processed or value-added agricultural products and assist
11those persons in ascertaining legal and regulatory
12restrictions and market preferences that affect the sale of
13value-added agricultural products in foreign markets.

15    Section 15. The Illinois Horse Racing Act of 1975 is
16amended by changing Section 28 as follows:
 
17    (230 ILCS 5/28)  (from Ch. 8, par. 37-28)
18    Sec. 28. Except as provided in subsection (g) of Section 27
19of this Act, moneys collected shall be distributed according to
20the provisions of this Section 28.
21    (a) Thirty per cent of the total of all monies received by
22the State as privilege taxes shall be paid into the
23Metropolitan Exposition Auditorium and Office Building Fund in
24the State Treasury.

1    (b) In addition, 4.5% of the total of all monies received
2by the State as privilege taxes shall be paid into the State
3treasury into a special Fund to be known as the Metropolitan
4Exposition, Auditorium, and Office Building Fund.
5    (c) Fifty per cent of the total of all monies received by
6the State as privilege taxes under the provisions of this Act
7shall be paid into the Agricultural Premium Fund.
8    (d) Seven per cent of the total of all monies received by
9the State as privilege taxes shall be paid into the Fair and
10Exposition Fund in the State treasury; provided, however, that
11when all bonds issued prior to July 1, 1984 by the Metropolitan
12Fair and Exposition Authority shall have been paid or payment
13shall have been provided for upon a refunding of those bonds,
14thereafter 1/12 of $1,665,662 of such monies shall be paid each
15month into the Build Illinois Fund, and the remainder into the
16Fair and Exposition Fund. All excess monies shall be allocated
17to the Department of Agriculture for distribution to county
18fairs for premiums and rehabilitation as set forth in the
19Agricultural Fair Act.
20    (e) The monies provided for in Section 30 shall be paid
21into the Illinois Thoroughbred Breeders Fund.
22    (f) The monies provided for in Section 31 shall be paid
23into the Illinois Standardbred Breeders Fund.
24    (g) Until January 1, 2000, that part representing 1/2 of
25the total breakage in Thoroughbred, Harness, Appaloosa,
26Arabian, and Quarter Horse racing in the State shall be paid

1into the Illinois Race Track Improvement Fund as established in
2Section 32.
3    (h) All other monies received by the Board under this Act
4shall be paid into the Horse Racing Fund.
5    (i) The salaries of the Board members, secretary, stewards,
6directors of mutuels, veterinarians, representatives,
7accountants, clerks, stenographers, inspectors and other
8employees of the Board, and all expenses of the Board incident
9to the administration of this Act, including, but not limited
10to, all expenses and salaries incident to the taking of saliva
11and urine samples in accordance with the rules and regulations
12of the Board shall be paid out of the Agricultural Premium
13Fund.
14    (j) The Agricultural Premium Fund shall also be used:
15        (1) for the expenses of operating the Illinois State
16    Fair and the DuQuoin State Fair, including the payment of
17    prize money or premiums;
18        (2) for the distribution to county fairs, vocational
19    agriculture section fairs, agricultural societies, and
20    agricultural extension clubs in accordance with the
21    Agricultural Fair Act, as amended;
22        (3) for payment of prize monies and premiums awarded
23    and for expenses incurred in connection with the
24    International Livestock Exposition and the Mid-Continent
25    Livestock Exposition held in Illinois, which premiums, and
26    awards must be approved, and paid by the Illinois

1    Department of Agriculture;
2        (4) for personal service of county agricultural
3    advisors and county home advisors;
4        (5) for distribution to agricultural home economic
5    extension councils in accordance with "An Act in relation
6    to additional support and finance for the Agricultural and
7    Home Economic Extension Councils in the several counties in
8    this State and making an appropriation therefor", approved
9    July 24, 1967, as amended;
10        (6) for research on equine disease, including a
11    development center therefor;
12        (7) for training scholarships for study on equine
13    diseases to students at the University of Illinois College
14    of Veterinary Medicine;
15        (8) for the rehabilitation, repair and maintenance of
16    the Illinois and DuQuoin State Fair Grounds and the
17    structures and facilities thereon and the construction of
18    permanent improvements on such Fair Grounds, including
19    such structures, facilities and property located on such
20    State Fair Grounds which are under the custody and control
21    of the Department of Agriculture;
22        (9) (blank); for the expenses of the Department of
23    Agriculture under Section 5-530 of the Departments of State
24    Government Law (20 ILCS 5/5-530);
25        (10) for the expenses of the Department of Commerce and
26    Economic Opportunity under Sections 605-620, 605-625, and

1    605-630 of the Department of Commerce and Economic
2    Opportunity Law (20 ILCS 605/605-620, 605/605-625, and
3    605/605-630);
4        (11) for remodeling, expanding, and reconstructing
5    facilities destroyed by fire of any Fair and Exposition
6    Authority in counties with a population of 1,000,000 or
7    more inhabitants;
8        (12) for the purpose of assisting in the care and
9    general rehabilitation of veterans with disabilities of
10    any war and their surviving spouses and orphans;
11        (13) for expenses of the Department of State Police for
12    duties performed under this Act;
13        (14) for the Department of Agriculture for soil surveys
14    and soil and water conservation purposes;
15        (15) for the Department of Agriculture for grants to
16    the City of Chicago for conducting the Chicagofest;
17        (16) for the State Comptroller for grants and operating
18    expenses authorized by the Illinois Global Partnership
19    Act.
20    (k) To the extent that monies paid by the Board to the
21Agricultural Premium Fund are in the opinion of the Governor in
22excess of the amount necessary for the purposes herein stated,
23the Governor shall notify the Comptroller and the State
24Treasurer of such fact, who, upon receipt of such notification,
25shall transfer such excess monies from the Agricultural Premium
26Fund to the General Revenue Fund.

2    Section 99. Effective date. This Act takes effect upon
3becoming law.
