1    AN ACT concerning property.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:

Article 5. Department of Natural Resources.

 
5    Section 5-30. The Director of the Department of Natural
6Resources, on behalf of the State of Illinois, is authorized to
7execute and deliver to the Peoria Park District, a park
8district organized and existing under the laws of the State of
9Illinois, of the County of Peoria, State of Illinois, for and
10in consideration of $1 paid to said Department, a quit claim
11deed to the following described real property:
 
12    Tract I:
13    Part of the East Half of the Southwest Quarter of Section
1433, Township 10 North, Range 8 East of the Fourth Principal
15Meridian, more particularly described as commencing at the
16center of said Section 33; running thence South on the East
17line of said Quarter Section 758 feet; thence South 46 degrees
18West 417.2 feet; thence North 1,075 feet to the North line of
19said Quarter Section; thence East along the North line of said
20Quarter Section; thence East along the North line of said
21Quarter Section 300 feet to the place of Beginning; situated in

22    Section 5-35. The conveyances of real property authorized
23by Section 5-30 shall be made subject to: (1) existing public
24utilities, existing public roads, and any and all reservations,
25easements, encumbrances, covenants and restrictions of record;

1and (2) the express condition that if said real property ceases
2to be used for public purposes, it shall revert to the State of
3Illinois, Department of Natural Resources.
4    Also, the following Natural Resources Preservation
5Covenant shall be an exhibit attached to the deed as a binding
6servitude upon the property and shall be deemed to run with the
7land:
 
8    In consideration of the conveyance of certain real property
9known as Peoria Salvation Army Woods Natural Area and located
10on East Poplet Hollow Road in the City of Peoria of the County
11Peoria, State of Illinois, being in Section 33 of Township 10
12North, Range 8 East of the Third Principal Meridian and legally
13defined in the foregoing deed to which this covenant is
14attached:
15    1. Grantee shall fully comply with all applicable state and
16federal laws, including but not limited to the Illinois State
17Agency Historic Resources Preservation Act (20 ILCS 3420/1 et
18seq.), the Illinois Natural Areas Preservation Act (525 ILCS
1930/1 et seq.), the Illinois Endangered Species Protection Act
20(520 ILCS 10/1 et seq.), the Interagency Wetland Policy Act of
211989 (20 ILCS 830/1-1 et seq.), the Human Skeletal Remains
22Protection Act (20 ILCS 3440/0.01 et seq.), and Section 106 of
23the National Historic Preservation Act of 1966, as amended, and
24the regulations promulgated under that Act (36 CFR Part 800.4).
25    2. No construction, alteration, or disturbance of the

1ground surface or structure older than 50 years shall be
2undertaken or permitted to be undertaken on the aforesaid
3property without the express prior written permission of the
4Illinois Department of Natural Resources, Comprehensive
5Environmental Review Program who may require archaeological or
6environmental surveys and/or site or structure mitigation
7prior to any undertaking.
8    3. The Illinois Department of Natural Resources shall be
9permitted at all reasonable times to inspect the aforesaid
10property in order to ascertain if the above conditions are
11being observed.
12    4. In the event of a violation of this covenant, and in
13addition to any remedy now or hereafter provided by law, the
14Illinois Department of Natural Resources may, following
15reasonable notice to the Grantee, institute suit to enjoin said
16violation or to require the restoration or mitigation of
17natural resources or archaeological sites or structures
18disturbed by construction, alteration, or disturbance of the
19ground surface or structure older than 50 years.
20    5. The Grantee agrees that the Illinois Department of
21Natural Resources may, at its sole discretion and without prior
22notice to the Grantee, convey and assign all or part of its
23rights and responsibilities contained herein to a third party.
24Written notice will be sent to the Grantee, to the attention of
25its Executive Director, within thirty (30) days of any such
26transfer.

1    6. This covenant is binding on the Grantee, its successors
2and assignees in perpetuity. Restrictions, stipulations, and
3covenants contained herein shall be inserted by the Grantee
4verbatim or by express reference in any deed or other legal
5instrument by which it divests itself of either the fee simple
6title or any other lesser estate in the property.
7    7. The failure of the Illinois Department of Natural
8Resources to exercise any right or remedy granted under this
9instrument shall not have the effect of waiving or limiting the
10exercise of any other right or remedy or the use of such right
11or remedy at any other time.
12    8. This covenant shall be a binding servitude upon the
13property and shall be deemed to run with the land. The
14acceptance of this conveyance by the Peoria Park District shall
15constitute evidence that the Peoria Park District agrees to be
16bound by the foregoing conditions and restrictions and to
17perform the obligations herein set forth.
 
18    Section 5-40. The Director of the Department of Natural
19Resources, on behalf of the State of Illinois, is authorized to
20execute and deliver to the City of Chicago Heights, a
21municipality organized and existing under the laws of the State
22of Illinois, of the County of Cook, State of Illinois, for and
23in consideration of $1 paid to said Department, a quit claim
24deed to the following described real property, to wit:

2    ALL THAT STRIP OR PARCEL OF LAND, ONE HUNDRED (100) FEET

20obtain a certified copy of the portions of this Act containing
21the title, the enacting clause, the effective date, the
22appropriate Section or Sections containing the land
23descriptions of the property to be conveyed, and this Section
24within 60 days after its effective date and, upon receipt of

1the payment required by the Section or Sections, if any payment
2is required, shall record the certified document in the
3Recorder's Office in the county in which the land is located.

Article 10. Department of Transportation.

 
5    Section 10-5. Upon the payment of the sum of $600 to the
6State of Illinois, the Secretary of Transportation, on behalf
7of the State of Illinois, is authorized to release the
8following described land located in Ogle County, Illinois from
9all dedication and easement rights, and interest acquired for
10highway purposes:
