SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Car Seat Recycling Act. Provides that manufacturers shall accept car seats for the purpose of recycling the material from the car seats. Requires manufacturers to dismantle a car seat if received intact and accept the dismantled materials from car seats. Provides that each manufacturer shall begin implementation of its recycling program within one year of the effective date of the Act. Contains requirements for the recycling program. Effective January 1, 2023.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Car
5Seat Recycling Act.
 
6    Section 5. Purpose. The purpose of this Act is to further
7the interest of the State of Illinois in reducing waste and
8providing the public a consistent method to properly dispose
9of car seats. Currently, the disposal of car seats results in a
10significant amount of waste every year. Many components of
11these car seats are largely recyclable. However, it is
12difficult for consumers to recycle the car seats on their own.
13Trade-in programs are largely inactive, new regulations in
14China prevent many recyclers from accepting car seats, and
15other methods such as donation are not meeting the needs of the
16public. It is on manufacturers of these car seats to properly
17manage the disposal of their products.
 
18    Section 10. Definitions.
19    "Car seat" means a regulated seat that protects a child
20who is too small or immature to safely use the adult seat belt
21system in a vehicle. "Car seat" includes booster seats, child
22restraint systems, and other regulated devices for children

1who have outgrown their child safety seats but are still too
2small to use an adult seat belt safely.
3    "Manufacturer" means a person, or a successor in interest
4to a person, under whose brand or label a car seat is or was
5sold at retail. For any car seat sold at retail under a brand
6or label that is licensed from a person who is a mere brand
7owner and who does not sell or produce a car seat, the person
8who produced the car seat or his or her successor in interest
9is the manufacturer. For any car seat sold at retail under the
10brand or label of both the retail seller and the person that
11produced the car seat, the person that produced the car seat,
12or his or her successor in interest, is the manufacturer.
13    "Program collection site" means a physical location that
14is included in a manufacturer's car seat recycling program and
15at which car seats are collected and prepared for transport by
16a collector during a program year in accordance with the
17requirements of this Act.
18    "Recycling program" means a program focused on the method,
19technique, or process designed to remove any contaminant from
20waste so as to render the waste reusable, or any process by
21which materials that would otherwise be disposed of or
22discarded are collected, separated, or processed and returned
23to the economic mainstream in the form of raw materials or
24products.
 
25    Section 15. Car Seat Recycling Program.

1    (a) Manufacturers shall accept car seats for the purpose
2of recycling the material from the car seats. A manufacturer
3shall dismantle a car seat if received intact. The
4manufacturer shall also accept the dismantled materials from
5car seats.
6    (b) Each manufacturer shall begin implementation of its
7recycling program within one year of the effective date of
8this Act. The recycling program:
9        (1) shall include public education and notification
10    programs to foster understanding and encourage use of the
11    recycling program;
12        (2) may require the participants to drop off car seats
13    only at program collection sites;
14        (3) shall provide the total number and weight of the
15    car seats received under the program and must include the
16    number of tons in material that manufacturers recycle in a
17    report that must be available on an annual basis and
18    publicly accessible; and
19        (4) shall include provisions for (i) identifying
20    potential markets for the recyclable materials and (ii)
21    promoting the use of products made from recovered or
22    recycled materials among businesses.
23    (c) In implementing the recycling program, a manufacturer
24may not distinguish between an individual and a business
25entity. Both individuals and business entities are eligible to
26participate in the recycling program.

1    Section 99. Effective date. This Act takes effect January
21, 2023.
