SYNOPSIS AS INTRODUCED:
 
430 ILCS 65/5  from Ch. 38, par. 83-5

    Amends the Firearm Owners Identification Card Act. Provides that if an application for a Firearm Owner's Identification Card has not been approved or denied within 30 days after its application has been received, it shall automatically be approved by the Illinois State Police. Provides that if a renewal application has not been approved or denied within 60 business days, it shall be automatically renewed by the Illinois State Police.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Firearm Owners Identification Card Act is
5amended by changing Section 5 as follows:
 
6    (430 ILCS 65/5)  (from Ch. 38, par. 83-5)
7    Sec. 5. Application and renewal.
8    (a) The Illinois Department of State Police shall either
9approve or deny all applications within 30 days from the date
10they are received, except as provided in subsection (b) of
11this Section, and every applicant found qualified under
12Section 8 of this Act by the Department shall be entitled to a
13Firearm Owner's Identification Card upon the payment of a $10
14fee. Any applicant who is an active duty member of the Armed
15Forces of the United States, a member of the Illinois National
16Guard, or a member of the Reserve Forces of the United States
17is exempt from the application fee. $6 of each fee derived from
18the issuance of Firearm Owner's Identification Cards, or
19renewals thereof, shall be deposited in the Wildlife and Fish
20Fund in the State Treasury; $1 of the fee shall be deposited in
21the State Police Services Fund and $3 of the fee shall be
22deposited in the State Police Firearm Services Fund. If an
23application for a Firearm Owner's Identification Card has not

1been approved or denied within 30 days after its application
2has been received, it shall automatically be approved by the
3Illinois State Police.
4    (b) Renewal applications shall be approved or denied
5within 60 business days, provided the applicant submitted his
6or her renewal application prior to the expiration of his or
7her Firearm Owner's Identification Card. If a renewal
8application has been submitted prior to the expiration date of
9the applicant's Firearm Owner's Identification Card, the
10Firearm Owner's Identification Card shall remain valid while
11the Illinois State Police Department processes the
12application, unless the person is subject to or becomes
13subject to revocation under this Act. The cost for a renewal
14application shall be $10 which shall be deposited into the
15State Police Firearm Services Fund. If a renewal application
16has not been approved or denied within 60 business days, it
17shall automatically be renewed by the Illinois State Police.
