SYNOPSIS AS INTRODUCED:

720 ILCS 5/31A-1.3 new

Amends the Criminal Code of 2012. Creates the offense of penal institution riot. Provides that a person commits the offense when he or she is an inmate in a penal institution and knowingly and in consort with one or more other inmates disturbs the good order of the institution by use or threat of force. Provides that a violation is a Class 4 felony.

AN ACT concerning criminal law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Criminal Code of 2012 is amended by adding Section 31A-1.3 as follows:

(720 ILCS 5/31A-1.3 new)

Sec. 31A-1.3. Penal institution riot.

(a) A person commits penal institution riot when he or she is an inmate in a penal institution and knowingly and in consort with one or more other inmates disturbs the good order of the institution by use or threat of force.

(b) Sentence. Penal institution riot is a Class 4 felony.
