SYNOPSIS AS INTRODUCED:
 
10 ILCS 5/19-13  from Ch. 46, par. 19-13

    Amends the Election Code. Includes a qualified voter who is in quarantine not more than 14 days before an election to those entitled to personal delivery of a vote by mail ballot.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing
5Section 19-13 as follows:
 
6    (10 ILCS 5/19-13)  (from Ch. 46, par. 19-13)
7    Sec. 19-13. Any qualified voter who has been admitted to a
8hospital, nursing home, or rehabilitation center due to an
9illness or physical injury or a qualified voter who is in
10quarantine not more than 14 days before an election shall be
11entitled to personal delivery of a vote by mail ballot in the
12hospital, nursing home, or rehabilitation center, or place of
13quarantine subject to the following conditions:
14    (1) The voter completes the Application for Physically
15Incapacitated Elector as provided in Section 19-3, stating as
16reasons therein that he is a patient in ............... (name
17of hospital/home/center), ............... located at,
18............... (address of hospital/home/center),
19............... (county, city/village), was admitted for
20............... (nature of illness or physical injury), on
21............... (date of admission), and does not expect to be
22released from the hospital/home/center on or before the day of
23election or, if released, is expected to be homebound on the

1day of the election and unable to travel to the polling place.
2    (2) The voter's physician, advanced practice registered
3nurse, or physician assistant completes a Certificate of
4Attending Health Care Professional in a form substantially as
5follows:

CERTIFICATE OF ATTENDING HEALTH CARE PROFESSIONAL
7    I state that I am a physician, advanced practice
8registered nurse, or physician assistant, duly licensed to
9practice in the State of .........; that .......... is a
10patient in .......... (name of hospital/home/center), located
11at ............. (address of hospital/home/center),
12................. (county, city/village); that such individual
13was admitted for ............. (nature of illness or physical
14injury), on ............ (date of admission); and that I have
15examined such individual in the State in which I am licensed to
16practice and do not expect such individual to be released from
17the hospital/home/center on or before the day of election or,
18if released, to be able to travel to the polling place on
19election day.
20    Under penalties as provided by law pursuant to Section
2129-10 of The Election Code, the undersigned certifies that the
22statements set forth in this certification are true and
23correct.

1precinct as the admitted voter or any legal relative of the
2admitted voter may present such voter's vote by mail ballot
3application, completed as prescribed in paragraph 1,
4accompanied by the physician's, advanced practice registered
5nurse's, or a physician assistant's certificate, completed as
6prescribed in paragraph 2, to the election authority. Such
7precinct voter or relative shall execute and sign an affidavit
8furnished by the election authority attesting that he is a
9registered voter in the same precinct as the admitted voter or
10that he is a legal relative of the admitted voter and stating
11the nature of the relationship. Such precinct voter or
12relative shall further attest that he has been authorized by
13the admitted voter to obtain his or her vote by mail ballot
14from the election authority and deliver such ballot to him in
15the hospital, home, or center.
16    Upon receipt of the admitted voter's application,
17physician's, advanced practice registered nurse's, or a
18physician assistant's certificate, and the affidavit of the
19precinct voter or the relative, the election authority shall
20examine the registration records to determine if the applicant
21is qualified to vote and, if found to be qualified, shall
22provide the precinct voter or the relative the vote by mail
23ballot for delivery to the applicant.
24    Upon receipt of the vote by mail ballot, the admitted
25voter shall mark the ballot in secret and subscribe to the
26certifications on the vote by mail ballot return envelope.

1After depositing the ballot in the return envelope and
2securely sealing the envelope, such voter shall give the
3envelope to the precinct voter or the relative who shall
4deliver it to the election authority in sufficient time for
5the ballot to be delivered by the election authority to the
6election authority's central ballot counting location before 7
7p.m. on election day.
8    Upon receipt of the admitted voter's vote by mail ballot,
9the ballot shall be counted in the manner prescribed in this
10Article.
