SYNOPSIS AS INTRODUCED:
 
605 ILCS 5/6-701.10 new

    Amends the Illinois Highway Code. Provides that, notwithstanding any provision of law to the contrary, if a municipality maintains a list of entities deemed by the municipality to be nonresponsible bidders and the municipality has its bidding process conducted by the Department of Transportation, the Department may not award all or part of any contract for work to be performed within that municipality to an entity deemed by that municipality to be a nonresponsible bidder. Excludes Department projects on State routes that pass through such a municipality. Effective June 1, 2021.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Highway Code is amended by adding
5Section 6-701.10 as follows:
 
6    (605 ILCS 5/6-701.10 new)
7    Sec. 6-701.10. Municipal contract prohibition for
8nonresponsible bidders. Notwithstanding any provision of law
9to the contrary, if a municipality maintains a list of
10entities deemed by the municipality to be nonresponsible
11bidders and the municipality has its bidding process conducted
12by the Department, the Department may not award all or part of
13any contract for work to be performed within that municipality
14to an entity deemed by that municipality to be a
15nonresponsible bidder. This Section does not apply to
16Department projects on State routes that pass through such a
17municipality.
 
18    Section 99. Effective date. This Act takes effect June 1,
192021.
