SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/12-4.54 new

    Amends the Illinois Public Aid Code. Requires every person applying for benefits under the federal Supplemental Nutrition Assistance Program to, at the time of application or subsequent redetermination of eligibility, submit to the Department of Human Services documentation demonstrating that the person is enrolled in an adult education program as defined in the Adult Education Act or in an educational program that is expected to result in the receipt of a high school equivalence certificate. Exempts certain persons from the requirement. Provides that the Department shall apply for any federal waiver, if required, to implement the requirement.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5adding Section 12-4.54 as follows:
 
6    (305 ILCS 5/12-4.54 new)
7    Sec. 12-4.54. SNAP; adult education requirement.
8Notwithstanding any other provision of this Code to the
9contrary, every person applying for benefits under the federal
10Supplemental Nutrition Assistance Program shall, at the time
11of application or subsequent redetermination of eligibility,
12submit to the Department of Human Services documentation
13demonstrating that the person is enrolled in an adult
14education program as defined in the Adult Education Act or in
15an educational program that is expected to result in the
16receipt of a high school equivalence certificate. The
17following persons are exempt from the requirement of this
18Section:
19        (1) Persons who are over the age of 60.
20        (2) Persons with a child under the age of one.
21        (3) Persons enrolled in a technical or trade school.
22    Persons with a disability as defined by the Americans with
23Disabilities Act are entitled to request a reasonable

1modification to the requirement of participation in an adult
2education program or educational program that is expected to
3result in the receipt of a high school equivalence
4certificate. Requests for a reasonable modification shall be
5evaluated on a case-by-case functional basis by designated
6staff based on Department rule.
7    The Department of Human Services shall apply for any
8federal waiver, if required, to implement the requirement
9under this Section. Implementation shall be contingent upon
10federal approval, if required.
