SYNOPSIS AS INTRODUCED:
 
815 ILCS 365/3 new

    Amends the Motor Fuel Sales Act. Defines "motor fuel" and "motor fuel dispensing unit". Requires that beginning January 1, 2022, any new motor fuel dispensing unit installed at a gas station, service station, or any other business that provides for the retail sale of motor fuel in this State must display or have the capability to display all operating instructions and warning signs both in English and Spanish. Provides that the provisions of this Act do not apply to motor fuel dispensing units installed prior to January 1, 2022. Provides that the Illinois Department of Agriculture shall adopt rules for the implementation and enforcement of this Act.

1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Motor Fuel Sales Act is amended by adding
5Section 3 as follows:
 
6    (815 ILCS 365/3 new)
7    Sec. 3. Definitions; operating instructions;
8applicability; rules.
9    (a) In this Section:
10    "Motor fuel" means all volatile and inflammable liquids
11produced, blended, or compounded for the purpose of, or which
12are suitable or practicable for, operating motor vehicles.
13"Motor fuel" includes "special fuel" as defined in Section
141.13 in the Motor Fuel Tax Law.
15    "Motor fuel dispensing unit" means any system, device, or
16pump for dispensing motor fuels or compressed natural gas into
17the fuel tanks of motor vehicles which is intended to be
18operated by the purchaser of such motor fuel or compressed
19natural gas.
20    (b) Beginning January 1, 2022, any new motor fuel
21dispensing unit installed at (i) gasoline stations and service
22stations in this State that offer to the public retail sales of
23motor fuel at both self-service and full-service islands or

1(ii) any other place of business in this State where motor
2fuels are dispensed into the fuel tanks of motor vehicles,
3internal combustion engines, or portable containers must:
4        (1) display all operating instructions and warning
5    signs permanently both in English and in Spanish; or
6        (2) have the capability that allows the customer to
7    select the option to display all operating instructions
8    and warning signs either in English or in Spanish.
9    (c) The provisions of this Section shall apply only to the
10installation of any new motor fuel dispensing unit that is
11installed on or after January 1, 2022. Any motor fuel
12dispensing unit installed prior to January 1, 2022 shall be
13exempt from the provisions of this Section.
14    (d) The Illinois Department of Agriculture shall adopt
15rules to implement and enforce the provisions of this Section.
