SYNOPSIS AS INTRODUCED:

430 ILCS 15/8 new

Amends the Gasoline Storage Act. Provides that every filling station or service station open to the general public shall make available, at each filling station or service station, self-service dispensing equipment that dispenses mid-grade E15 for use in motor vehicles and motor vehicle engines and shall offer mid-grade E15 for sale. Provides that every filling station or service station subject to the requirements of the provisions shall comply with specified labeling requirements that apply to retailers and wholesale purchaser-consumers of gasoline-ethanol blends that contain greater than 10% by volume of ethanol and not more than 15% by volume of ethanol. Provides that the requirements of the provisions shall not apply to specified filling stations. Effective January 1, 2023.

A BILL FOR

AN ACT concerning safety.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Gasoline Storage Act is amended by adding Section 8 as follows:

(430 ILCS 15/8 new)

Sec. 8. E15 consumer choice.

(a) The General Assembly finds that:

(1) E15 is a blend of gasoline and up to 15% by volume of ethanol.

(2) Ethanol is a renewable domestic fuel that burns cleaner than gasoline.

(3) Illinois is the third largest ethanol producing state in the nation, with 13 ethanol plants that can produce 1.6 billion gallons of ethanol per year.

(4) The United States Environmental Protection Agency has approved the use of E15 in cars of the model year 2001 or later.

(5) E15 is significantly less expensive than conventional gasoline, with expected savings between 5 and 15 cents per gallon.

(6) According to the Argonne National Laboratory, higher ethanol blends such as E15 will help expand use of corn ethanol, which reduces greenhouse gas emissions by 34% relative to those of gasoline.

(7) Transportation accounts for 21% of all greenhouse gas emissions in the city.

(8) Infrastructure provides access to cleaner alternative fuels.

(b) Every filling station or service station open to the general public shall make available, at each filling station or service station, self-service dispensing equipment that dispenses mid-grade E15 for use in motor vehicles and motor vehicle engines and shall offer mid-grade E15 for sale.

(c) Every self-service filling station subject to the requirements of this Section shall comply with the labeling requirements of 40 C.F.R. 80.1501 that apply to retailers and wholesale purchaser-consumers of gasoline-ethanol blends that contain greater than 10% by volume of ethanol and not more than 15% by volume of ethanol.

(d) The requirements of this section shall not apply to:

(1) a filling station at which the average annual volume of fuel sales is less than 850,000 gallons;

(2) a filling station at which the underground storage tanks are not compatible with the storage of blended fuel in accordance with Section 175.415 of Chapter I of Title 41 of the Illinois Administrative Code, as amended; and

(3) a filling station located at a marina.

(e) In this Section:

"Marina" means a facility located on a body of water that provides for the storage (wet and dry), launching, and mooring of pleasure boats together with one or more accessory retail and service uses, such as marine equipment sales, showers, private clubs and restaurants.

"Mid-grade E15" means a gasoline-ethanol blend with an 88 octane rating or higher that contains greater than 10% by volume of ethanol and not more than 15% by volume of ethanol.

"Watercraft" means any boat, vessel, or other craft used or capable of being used as a means of transportation on water.

Section 99. Effective date. This Act takes effect January 1, 2023.
