SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/14-7.01a new

    Amends the Children with Disabilities Article of the School Code. Provides that the parent or guardian of a child with disabilities who resides in a school district shall have the option of enrolling the child in a school district in which the child was previously enrolled as long as that school district is, in whole or in part, within the county in which the child currently resides. Requires the school district in which the child currently resides to grant proper permit to the child's parent or guardian to allow the child to enroll in a school district outside of the district in which he or she resides. Sets forth provisions concerning special education reimbursement, evidence-based funding, and transportation costs. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
514-7.01a as follows:
 
6    (105 ILCS 5/14-7.01a new)
7    Sec. 14-7.01a. Children enrolling in previous district.
8    (a) In this Section, "enrolling school district" means a
9school district in which a parent or guardian chooses to
10enroll a child with disabilities outside of the school
11district in which the child currently resides, but within, in
12whole or in part, the county in which the child currently
13resides.
14    (b) The parent or guardian of a child with disabilities
15who resides in a school district shall have the option of
16enrolling the child in a school district in which the child was
17previously enrolled as long as that school district is, in
18whole or in part, within the county in which the child
19currently resides. The school district in which the child
20currently resides shall grant proper permit to the child's
21parent or guardian to allow the child to enroll in a school
22district outside of the district in which he or she resides.
23    (c) For purposes of reimbursement under this Article and

1for evidence-based funding purposes under Section 18-8.15 of
2this Code, a child with disabilities enrolled as permitted
3under subsection (b) of this Section shall be a pupil enrolled
4in the enrolling school district.
5    (d) The parent or guardian of a child with disabilities
6enrolled as permitted under subsection (b) of this Section
7shall incur all costs associated with transportation, and
8neither school district is eligible for transportation
9reimbursement under Section 14-13.01 or Section 29-5 of this
10Code.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.
