SYNOPSIS AS INTRODUCED:
 
20 ILCS 3805/7.32

    Amends the Illinois Housing Development Act. Provides that of the funds received by the Illinois Housing Development Authority for Homeowner Assistance under the federal American Rescue Plan Act of 2021, at least 20% shall be allocated to counties and municipalities on the basis of: (i) per capita plus; and (ii) number of housing units that are over 50 years old, to be used to aid eligible persons in coming into compliance with building code violations. Provides that eligible persons are those who are the owner-occupier of the residence, with an income level that is 200% of the federal poverty level or 50% of the median income of the county.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Housing Development Act is amended
5by changing Section 7.32 as follows:
 
6    (20 ILCS 3805/7.32)
7    Sec. 7.32. American Rescue Plan Homeowner Assistance and
8Emergency Rental Assistance.
9    (a) The Authority may receive, directly or indirectly,
10federal funds from the Homeowner Assistance Fund authorized
11under Section 3206 of the federal American Rescue Plan Act of
122021 (Public Law 117-2), and may use the funds only in the
13manner and for the purposes authorized therein and in related
14federal guidance.
15    (a-5) Of the funds received by the Authority under
16subsection (a), at least 20% shall be allocated to counties
17and municipalities on the basis of: (i) per capita plus; and
18(ii) number of housing units that are over 50 years old, to be
19used to aid eligible persons in coming into compliance with
20building code violations. For purposes of this subsection
21(a-5), "eligible persons" means those who are the
22owner-occupier of the residence, with an income level that is
23200% of the federal poverty level or 50% of the median income

1of the county.
2    (b) The Authority may receive, directly or indirectly,
3federal funds from the Emergency Rental Assistance Program
4authorized under Section 3201 of the federal American Rescue
5Plan Act of 2021 and Section 501 of Subtitle A of Title V of
6Division N of the Consolidated Appropriations Act, 2021
7(Public Law 116–260), and may use the funds only in the manner
8and for the purposes authorized therein and in related federal
9guidance.
