SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/3-1.1  from Ch. 122, par. 3-1.1

    Amends the Regional Superintendent of Schools Article of the School Code. Provides that whenever an elementary, high school, or unit school district (rather than just a unit school district) is located in more than one educational service region, a qualified elector residing in that school district but outside of the educational service region administered by the regional superintendent of schools having supervision and control over that school district shall be eligible to vote in any election held to elect the regional superintendent of schools who has supervision and control over that school district. Removes a provision that provides that the elector shall not also be eligible to vote in the election held to elect the regional superintendent of schools of the educational service region in which the elector resides. Makes conforming changes. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
53-1.1 as follows:
 
6    (105 ILCS 5/3-1.1)  (from Ch. 122, par. 3-1.1)
7    Sec. 3-1.1. Eligible voters. Whenever an elementary, high
8school, or a unit school district is located in more than one
9educational service region, a qualified elector residing in
10that elementary, high school, or unit school district but
11outside of the educational service region administered by the
12regional superintendent of schools having supervision and
13control over that elementary, high school, or unit school
14district shall be eligible to vote in any election held to
15elect the regional superintendent of schools of the
16educational service region that is administered by the
17regional superintendent of schools who has supervision and
18control over that elementary, high school, or unit school
19district, but the elector shall not also be eligible to vote in
20the election held to elect the regional superintendent of
21schools of the educational service region in which the elector
22resides.
23    Not less than 100 days before each general primary

1election, the regional superintendent of schools shall certify
2to the State Board of Elections a list of each elementary, high
3school, or unit school district under his or her supervision
4and control and each county in which all or any part of each of
5those districts is located. The State Board of Elections shall
6certify each of those elementary, high school, or unit school
7districts and counties to the appropriate election authorities
8within 20 days after receiving the list certified by the
9regional superintendent of schools.
10    The election authority in a single county educational
11service region whose regional superintendent of schools
12exercises supervision and control over an elementary, high
13school, or a unit school district that is located in that
14single county educational service region and in one or more
15other educational service regions shall certify to the
16election authority of each of those other educational service
17regions in which the elementary, high school, or unit school
18district is located the candidates for the office of the
19regional superintendent of schools exercising supervision and
20control over that elementary, high school, or unit school
21district.

23    Section 99. Effective date. This Act takes effect upon
24becoming law.
